(LRM) is submitting the following response to the cited corrective <br /> actions. We appreciate your comprehensive report, your input, and the opportunity <br /> to evaluate the progress of our Reclamation Plan. <br /> After careful review of the inspection report LRM disputes the total recommended <br /> increase in the financial warranty and is submitting documentation that justifies a <br /> reduction in the Division's February 19, 2020 bond estimate. <br /> Cell/Pit 20 We believe Tasks 021,022, and 023 in the Division's revised bond estimate <br /> are incorrect. Our reasoning is outlined below. <br /> 1. Mining at Cell 20 has been completed, Photo 10 in the inspection report shows <br /> that sides are sloped and area around cell has been graded.The attached <br /> storage stage table from the final survey shows the current exposed water <br /> surface area of Cell 20 is approximately 8.525 acres. <br /> 2. Cell 20 was completely filled on December 5, 2019 in accordance with the <br /> SWSP. First fill requirements of the SWSP have been met. <br /> 3. Water loss from evaporative depletions from Cell 20 are covered in the State <br /> approved augmentation plan 00CW142. Section 14.3 of this decree <br /> acknowledges that mining operations are ongoing at the Larimer Pits. <br /> Paragraph 14.3.1 allows for"Up to 52.29 acres of ground water surface area <br /> were, or will be, exposed to the atmosphere by mining the Larimer Pits <br /> 13,14,15,18, and 20 resulting in net evaporation averaging 109.24 acre-feet <br /> per year(gross evaporation less historic natural depletions) as shown on <br /> Exhibit C. <br /> 4. The current Well Permit 69035-F allows for"an additional 12.02 acres to be <br /> exposed at the Larimer Pit within pond nos. 18 and 20." It also references the <br /> total surface area of the gravel pit ground water pond nos. 13, 14, 15, 18, and <br /> 20 limited to 52.29 acres exposed. <br /> Wage <br />
