Compliance With Mine Plan R - Support Facilities Not On-site <br /> N - Other N - Special Categories Of Mining <br /> R -Processing Waste R -Topsoil <br /> COMMENTS <br /> A partial inspection was conducted by Daniel Cunningham, Jared Ebert, and Peter Hays of the Division or <br /> Reclamation,Mining and Safety(DRMS or Division) on March 11,2020. The weather was warm and clear. <br /> Vince Massarotti and Nick Mason of New Elk Cost Company, LLC (NECC)was present for the inspection <br /> HYDROLOGIC BALANCE - Rule 4.05 <br /> Drainage Control 4.05.1,4.05.2, 4.05.3; Siltation Structures 4.05.5,4.05.6; Discharge Structures 4.05.7,4.05.10; <br /> Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br /> Drainage—Acid and Toxic Materials 4.05.8; Impoundments 4.05.6,4.05.9; Stream Buffer Zones 4.05.18: <br /> Ditches 2, 3,4, 6, 7, 9, 10, 10A, 11, 12, 13, 14, 16, 17A, 17B, and 18D were inspected. Ditch 11,near the eastern <br /> end of the ditch, did not appear to be in compliance with the current design of having a capacity for a 100-year, <br /> 24-hour event.NECC must clean and re-configure Ditch 11. All other ditches were clear of debris. <br /> Culverts (5, 7, 8,28,29, 50, 60). All culverts were clean and free of debris <br /> Ponds 004A, and 001A were inspected.None of them were discharging,but pond 001A held at a small amount of <br /> water.No issues were seen with the embankments or spillways of the ponds. There was no evidence that water <br /> was being moved via pipes during the time of the inspection. <br /> PROCESSING WASTE/COAL MINE WASTE PILES—Rule 4.10 and 4.11 <br /> Drainage Control; Surface Stabilization; Placement: <br /> No erosion and good vegetation was seen on the reclaimed Developmental Waste Disposal Area(DWDA). <br /> Some erosional issues were noted on the DWDA#2,with minor rills noted throughout. A small amount of <br /> standing water was seen on the western end of the DWDA#2,however a sump was in place for sediment control <br /> before water discharges into culvert C 13.The Division recommends the Operator continues to monitor the rills <br /> Number of Partial Inspection this Fiscal Year: 6 <br /> Number of Complete Inspections this Fiscal Year: 3 <br /> Page 2 of 7 <br />
