Addressed responses to comments received by the DRMS: <br /> 1. State Historic Preservation. <br /> a. A class III cultural resources inventory was conducted by Grand River Institute on the <br /> affected lands of the permit area between August 9th and August 111h of 2019. The <br /> affected lands are the only lands that will be disturbed within the permit area. Grand <br /> River institute submitted their findings to the Colorado State Land Board. <br /> b. Within the area that will be affected by mining operations (Affected Lands). As <br /> identified within the report six prehistoric sites (two sites and four isolates). Sites <br /> 5MF8727 and 5MF8728 area open camps and the remaining locations are considered <br /> prehistoric isolates. <br /> c. Site 5MF8727, a prehistoric open camp is evaluated as eligible. The other five sites are <br /> deemed as not eligible. <br /> d. Uinta Mining has committed to protect site 5MF8727 by avoiding any disturbance <br /> within the boundaries of this site and has committed to that within the mining permit <br /> with DRMS. <br /> 2. Colorado Parks and Wildlife <br /> a. Uinta Mining proposes to disturb only a small portion of the permit area, approximately <br /> 140 acres of the 480 acres of the permit area. The affected lands lie between two small <br /> ridges along with some surface to the south between the south ridge and county road <br /> 104. Those valleys and grass lands to the north within the permit boundaries will be <br /> undisturbed allowing continued critical habitat for elk and deer. <br /> b. Economically Uinta Mining requires only one shift per day for mining operations, being <br /> day shift. That shift requires a 12 hour work period beginning 7:OOAM to 7:0013M. This <br /> will need to occur year round. <br /> c. Because of the small foot print of disturbance,the existing noise and impact of the <br /> County road 104,the community of Skull Creek,the operation of the Colorado Dept. of <br /> Transportation shed and operations area, Highway 40, and the overall range of elk and <br /> deer habitat around the project area suggests that this operation will have little impact <br /> to winter range. <br /> 3. Colorado Division of Water Resources <br /> a. Uinta Mining has obtained rights to use water for dust suppression on an existing well <br /> located on Lot 50 of Skull Creek Estates. This well was initially drilled in 1982 under <br /> permit number 126165. The State of Colorado, Division of Water Resources has given <br /> conditional approval for one year clean, install pumps, and test. <br /> b. The well ownership is held by the Frances Barnett Lewis Trust. In turn the trust has <br /> leased the water rights to Uinta Mining, LLC for the use of the well in regard to dust <br /> suppression for roads and pads. Change of ownership to the trust was done on form <br /> GWS-11, Colorado Division of Water Resources. Change of use was also completed on <br /> form GWS-45 under well permit 126165. <br /> 4. U.S.Army Corps of Engineers <br /> a. Uinta Mining, LLC commits to not disturbing wet lands or waters of the United States. <br /> No mining operation or road crossings associated with mining operations which would <br />
