<br /> Dear Mr. Lucas:
<br /> I have been retained by The Hundred Acre Ranch, LLC, to assist them in proposed work being done at
<br /> their Hundred Acre Ranch, formerly the Wommer Ranch, which is located in the Los Pinos River Valley
<br /> approximately 5 miles North of Bayfield west of CR-501 and east of the Pine River, in SE %4 of Section 11,
<br /> T35N R7W, 10t" (NM) PM, consisting of 97.31 acres.
<br /> The owners propose to excavate alluvial earth, sand and gravel to produce up to 40,000 tons of construction
<br /> materials (aggregates) and up to 50,000 of fines (silt for soil amendments), to be used entirely on that
<br /> property for improvements to the property. No construction materials (products or byproducts) will be
<br /> transported from the property. The work is expected to be done in the next 60-120 days.
<br /> The plan is to remove silt from the existing 4-acre pond on the property, then to excavate pit run material
<br /> which will be processed (to include as necessary crushing, screening, and washing) to produce the
<br /> materials. The materials will either be used immediately or stored on-site until used for improvements to
<br /> roads, parking areas, pads for structures, improvement of soil, and other similar uses. Excavation from the
<br /> pond will serve two purposes:to restore the pond by removing sediment which has filled much of the storage
<br /> capacity of the pond, as well as producing the needed construction materials. The surface area of the pond
<br /> will NOT be increased, and existing drainage, including flow in irrigation ditches, will not be permanently
<br /> changed. Excavation depth is not expected to exceed 20 feet below the present grade.
<br /> If material in the floor of the pond is not sufficient, other areas will be excavated, with the intent that the
<br /> excavation be in a location and shallow enough not to expose ground water, and then be reclaimed as
<br /> cropland.
<br /> A working area will be established near the pond for a crushing/screening/wash plant to be set up to process
<br /> the material from the pond. Three stockpile areas will be established, first for sediment removed from the
<br /> pond, second for the pitrun material removed from the pond, and third for the processed construction
<br /> materials. The areas will allow for dewatering of the raw materials, as well as storage until the materials
<br /> are used on-site. We do not believe that the proposed excavation, processing, and related work will be
<br /> located within 200 feet of any other parcel
<br /> The locations for the excavation, plant area and stockpiles, as well as access and haul roads, will be
<br /> selected to minimize environmental impact, including impacts on floodplain, erosion and sedimentation,
<br /> dust, noise, water quality, grazing, and other matters. All affected areas will be reclaimed, either for their
<br /> original use (water resource, grazing land, cropland) or improved cropland.
<br /> The proposed improvements to the Hundred Acre Ranch will be done in accordance with permits(including
<br /> special use, conditional use, high impact, building, and other permits) issued by La Plata County or other
<br /> local government agencies.
<br /> The proposed excavation and associated work is being coordinated with the Division of Reclamation Mining
<br /> and Safety, Division of Water Resources, Air Pollution Control Division, Water Quality Control Division (for
<br /> process and storm water), Pine River Irrigation District, US Army Corps of Engineers, Fire Protection
