In March 2002 during a previous amendment the <br /> operator' s consultant requested information from the U.S. Army Corps of <br /> Engineers regarding mining in the Sand Arroyo, an ephemeral sand draw <br /> that floods periodically. The Corps assigned Action No. 2002 0183 to <br /> the activity. I have included a copy of the correspondence they <br /> received in 2002 for your review. I also included a copy of the vicin- <br /> ity map so you have the location and the Mining Plan Map showing the <br /> permit area and location of mining activities . At that time a determi- <br /> nation was issued for 2 years. <br /> A little background, mining has been taking place on this site <br /> for over 70 years . They typically mine 10 to 20, 000 tons of sand per <br /> year from the property, much of it from the drainage area. No materi- <br /> als, of any kind, are placed within the banks of the drainage way. <br /> During processing the material is place on an upland area and later <br /> hauled off site . They mine to a depth of 8 to 10 feet below the <br /> channel bottom to avoid exposing ground water and grade the slope into <br /> the excavation. Due to the lack of flooding in the past few years the <br /> sand deposit is very low so predominately they are mining on upland <br /> sand deposit for now. The Walsenburg Sand and Gravel Company says <br /> there has not been sufficient flow down the draw to replenish the sand <br /> for at least 25 years . <br /> What I need is information to give to the state that says it is <br /> ok to continue mining in the sand draw, weather by obtaining a 404 <br /> permit or because no permit is needed. It would preferably be for more <br />
