EXHIBIT M <br /> OTHER PERMITS AND LICENSES REQUIRED <br /> 1 . An Air Pollution permit is not needed since less then 70 , 000 <br /> tons per year are mined from this site . <br /> 2 . The existing Conditional Use Permit in Huerfano County <br /> covers the entire 67 . 65 acres . <br /> 3 . This is an open pit operation and ground water will not be <br /> exposed so a well permit and temporary supply plan is unnec- <br /> essary. A well owned by The Walsenburg Sand and Gravel Co. <br /> is available to supply water for washing if needed, Permit <br /> #12262F - Water case # W0464 . <br /> 4 . Letter dated March 2 , 2002 from the U. S . Army Corps of <br /> Engineers is provided in Exhibit G - Water showing no 404 <br /> permit is needed. The corps has been contacted for an <br /> update to this letter and if they determine a 404 permit is <br /> needed to continue to mine in the Sand Arroyo channel it <br /> will be obtained. <br /> 5 . A Storm Water Management Plan (SWMP) will be prepared for <br /> this pit if there is a potential for surface water leaving <br /> the site . <br /> 6 . A CDPS permit to cover stormwater runoff is not required. <br /> All stormwater will be retained on site and allowed to soak <br /> into the sand substrata . No dewatering takes place at this <br /> mine . <br /> 34 (REVISED 3/6/2020) <br />
