RECEIVED February 28, 2020 <br /> MAR �)3 ''UZU <br /> Mr. Elliott Russell, DIVISION OF RECLAMATION, <br /> MINING AND SAFETY <br /> The following is in response to the adequacy review. <br /> 1. Proof of publication in a newspaper was sent to you and you received it on 2.28.2020. <br /> 2. Proof of the notice to all owners of record was sent and you received the proof on <br /> 2.28.2020. <br /> 3. I/we acknowledge the comments from the Division of Water Resources and the Office of <br /> Archaeology and Historical Preservation and will comply with all requirements and state <br /> laws. <br /> 4. Please note that under Exhibit C, the 5-10 feet of topsoil to be salvaged has been <br /> changed to 4-6 inches, we will be moving overburden and the approximate thickness of <br /> the overburden will be 9.5 feet. I have also corrected the topsoil to be salvaged under <br /> Exhibit D to read 4-6 inches. <br /> 5. I/we will commit to obtaining the appropriate USFS authorization. I/we have sent in an <br /> MPO to the USFS in Fairplay, CO and as soon as we obtain proper authorization, you will <br /> get a copy. <br /> 6. The Mine Plan has been changed to read surface mine operation only. <br /> 7. For the "worse-case" scenario, 400 cubic yards will be the most but most likely, we will <br /> have 55.56 cubic yards needing to be backfilled. <br /> 8. I/we are committing to the $2300.00 bond that is set forth to be paid. <br /> 9. On Exhibit D, 1H:1V was stated to be the final grade of slopes. I have changed this to <br /> read 3H:1V as I believe this would be appropriate. I have also included this in the <br /> Reclamation Plan Map as well. <br /> 10.We plan to plant Ponderosa Pine sapling trees. We plan to plant 25 trees in the area <br /> that we disturb. <br /> 11.We will not use fertilizer in the area that we disturb. <br /> 12.1/we will commit to sending the permit application to the USFS. <br /> 13.AI1 changes have been placed on file for public review. <br /> Thank You, <br /> Mrs. Yvette Downing <br />
