This TR is necessary to better define the postmining
land uses and locations that exist within the permit. OMLLC continues to pursue opportunities
for alternate postmining uses now that the property is in the reclamation/bond release phase of
the mining process.
At this time,North Fork Energy, LLC (NFELLC) continues to operate the Coal Mine Methane
Project at the Elk Creek Mine. Gunnison Energy, LLC leases office space and will continue to
use the property to support its activities including equipment and material delivery and storage.
The Gunnison County Sherriff s Office leases office space at the Mine Facility. The Somerset
Cemetery and Culinary Water System remain in place. The Union Pacific Railroad Corporation
right of way remain as industrial/mining post mining land use to provide service to West Elk
Mine and services to Gunnison Energy, LLC.
Earlier revisions, TR-75 and TR-76, addressed adjustments to post mine land use of areas from
the pre-disturbance undeveloped land post mining use to an industrial/mining land use while the
mine was in operation. Now that the mining has ceased, this TR-78 is intended to better define
the locations described in the permit that are to be used or be available for industrial/mining post
mining land use. TR-76 detailed 17.1 acres as being industrial/mining post mine land use.
This TR-78 includes these areas as continuing to be industrial/mining post mine land use, which
have not been previously identified:
The Somerset Culinary Water System storage, treatment, and intake gallery areas. (7 ac.)
Abandoned Delta Montrose Electric Association Site (2.0 ac.)
Active Mine Rail Loadout facility (West Elk Mine) (6.7 ac.)
Main Facility, storage and transloading areas (22.0 ac.)
Rail Road Right of way(46.6 ac.)
The historic Somerset Cemetery shall remain in its pre-mining condition as a cemetery(0.88 ac.)
