D
OLORADO
ivision of Water Resources
)c Department of Natural Resources
Response to Reclamation Permit Application Amendment Consideration
DATE: February 27, 2020
TO: Eric C. Scott, Environmental Protection Specialist
CC: Division 1 Office, District 5 Water Commissioner
FROM: loana Comaniciu, P.E.
RE: The Shores, File No. M-1998-013, AM03
Operator: Mark Johnson, Burnco dba Bestway Concrete Company,
(970) 587-7277
Contact: Andy Rodriguez, Civil Resources (303)
833-1416
Sec. 1 Et 2, Twp. 2 North, Rng. 68 West, 6th P.M., and Sec. 36, Twp. 3
North, Rng. 68 West, 6th P.M., Weld County
COMMENTS: The applicant has requested to add 140.7 acres to the existing 370.1 permitted
acres, for a total of 510.8 permitted acres. This amendment increases the reserves of gravel
in the mine. The proposed operation will continue to consume ground water through
evaporation, dust control, reclamation, water removed with the mined product, processing,
dewatering and concrete batching. In accordance with Section 37-90-137(2) and (11), C.R.S.,
the applicant obtained a substitute water supply plan ("SWSP") and well permit no. 61716-F.
However with the proposed expansion the Applicant will be required to obtain a new SWSP or
well permit if additional acreage will be exposed beyond what is allowed by the SWSP or the
well permit no. 61716-F. So long as the Shores Pit is operated in accordance with an approved
SWSP or approved plan for augmentation, this office has no objection to the request.
Any storm water runoff intercepted by this operation that is not diverted or captured in
priority must infiltrate into the ground or be released to the stream system within 72 hours.
Otherwise, the operator will be required to make replacements for evaporation.
The applicant may contact the State Engineer's Office with any questions.
/-0 co
lkw \p
1313 Sherman Street, Room 821,Denver, CO 80203 P 303.866.3581 www.colorado.gov/water
Jared S.
