Reilley AREW,, <br /> 2 4 2020 <br /> Division of Reclamation,Mining and Safety <br /> 1313 Sherman St.,Room 215 <br /> Denver,Colorado 80203 <br /> Re:Yoast Mine (Permit No C-1994-082) Permit Renewal Application No. 5(RN-5) (HC#: 67384) <br /> Dear Ms.Reilley: <br /> Thank you for your correspondence dated February 7,2020,received by our office on Februan' 12,2020,for the <br /> referenced project under Section 106 of the National Historic Preservation Act. <br /> After review of the documentation provided,we note that as a part of the Yoast Mine (Permit No. C-1994-082) <br /> Permit Renewal Application No. 5(RN-5),there are no proposed revisions to the approved training and reclamation <br /> plan. <br /> A search of the Colorado Cultural Resource Inventory (CCRI) database indicated 26 previous cultural resource <br /> inventories have been conducted in the specific proposed permit area (see Table 1). In addition,the database also <br /> indicated that 68 previously recorded sites in or near the area of proposed action, five of which are prehistoric sites <br /> (5RT.2741, 5RT.2745, 5RT3054, 5RT.3196, 5RT.3198) that are determined either Officially Needs Data or Field <br /> Need Data (see'Fable 2). <br /> As none of the properties have been nominated for inclusion in or accepted by the state register,additional <br /> protection is not required by this act. Nevertheless,we recommend avoidance of all officially eligible, field eligible, <br /> and officially needs data sites,if possible. Please keep in mind that our files contain incomplete information for this <br /> area,as most of Colorado has not yet been inventoried for cultural resources. As a result,there is the possibility that <br /> as yet unidentified cultural resources exist within the proposed permit area. <br /> Although the referenced renewal application does not propose revisions to the existing plan,we understand that <br /> the permit area does include BLM land.As such,we would like to remind DRMS that it is the responsibility of the <br /> Federal agencies involved to comply with Section 106 of the National Historic Preservation Act as set forth in 36 <br /> CFR Part 800 ("Protection of Historic Properties"). This includes the identification of any historic properties <br /> within the area of potential effects and determining whether the undertaking will have an effect upon such <br /> properties. While the surface disturbances planned are within the area currently approved for disturbance, there <br /> may be potential subsidence impacts throughout the Permit Area,which could have an adverse effect on those <br /> resources considered eligible for listing to the National Register of Historic Places. <br /> The State Historic Preservation Office,Native American tribes,representatives of local governments,and <br /> applicants for Federal permits,licenses or other approval are entitled to consultative roles in this process. <br /> Additionally, should human remains be discovered during mining activities, the requirements under State law CRS <br /> 24-80 part 13 apply and must be followed. <br /> Thank you for the opportunity to comment.
