PERMIT#: M-2010-047 <br /> INSPECTOR'S INITIALS:ECS <br /> INSPECTION DATE:January 23,2020 <br /> OBSERVATIONS <br /> This was a routine monitoring inspection of the 40.2 acre Lone Tree Pit. Eric Scott of DRMS met permittee <br /> representative Brady Miller at the site entrance from CR 37 with him. The permit identification sign was <br /> present at the site entrance, however it was lying face down on the ground and will need to be properly <br /> remounted (photo 1). The permit boundary was adequately marked with existing fencing. <br /> The site has been recently active, and the affected area based on aerial photography of the site remains <br /> approximately 18 acres. Mr. Miller stated that the property has recently been sold, and a DRMS review of the <br /> Weld County Assessor's site indicates that the property is now owned by C& H Excavation LLC. As stated in <br /> the first section of this report, the current permittee (Miller Family Investments) is now required to submit an <br /> executed Right of Entry agreement with the current property owner as required by Rule 6.4.14. Alternatively, <br /> the current permittee and new property owner may submit a complete Succession of Operator revision <br /> package to the Division for review by the corrective action date. <br /> The Division also believes, based on this inspection, that the financial warranty is not adequate to reclaim the <br /> site in accordance with the approved reclamation plan at this time. The required increase is due primarily to <br /> the fact that the existing bond has not been adjusted since the permit was issued in 2010. However, the <br /> extent of the disturbance within the affected 18 acres, and the observation that site has not been mined at a <br /> 3:1 slope as required by the approved mining plan will also be factors increasing the required reclamation <br /> bond. The Division will recalculate the required reclamation bond based on conditions observed during this <br /> inspection and the approved reclamation plan. A surety increase will then be issued under separate cover. <br /> The operator will have 60 days from the date on the surety increase notice to post the additional financial <br /> warranty. Alternatively, the bond may be adjusted as required during the succession of operator approval <br /> process. <br /> Other issues requiring correction were identified during this inspection as summarized in the previous section <br /> of this report. These issues will require corrective action and/or submittal of a technical revision (TR) to <br /> modify the approved permit and include: the exposure of approximately 1200 square feet of groundwater, the <br /> failure to mine at a 3:1 slope, and failure to maintain a surface drainage pathway for Lone Tree Creek through <br /> the site. <br /> Proof of completed corrective actions, or an appropriate technical revisions for issues listed above should be <br /> submitted to DRMS prior to the corrective action date shown. <br /> No other issues were noted during this inspection. <br /> Inspection Contact Address <br /> Brady Miller <br /> Miller Family Investments,LLC <br /> 428 N.2nd St. <br /> La Salle,CO 80645 <br /> Page 3 of 4 <br />
