PERMIT#: M-1981-286 <br /> INSPECTOR'S INITIALS: ECS <br /> INSPECTION DATE:January 23,2020 <br /> intends to conduct the operation. <br /> CORRECTIVE ACTIONS: The operator shall submit a Technical Revision, with the required $216 revision fee, to <br /> update and clarify the current approved mine plan to reflect existing and proposed activities by the corrective <br /> action date. <br /> CORRECTIVE ACTION DUE DATE: 3/27/20 <br /> INSPECTION TOPIC: Signs & Markers <br /> PROBLEM/POSSIBLE VIOLATION: Problem: The affected area boundary markers are missing or incorrectly <br /> placed. This is a problem for failure to maintain boundary markers around the affected area as required by <br /> Section 3.1.12(2) of the rule. <br /> CORRECTIVE ACTIONS:The operator shall conduct a survey and replace the boundary markers in the correct <br /> location(s). The operator shall provide proof to the Division that this has been done by the corrective action <br /> date. <br /> CORRECTIVE ACTION DUE DATE: 3/27/20 <br /> OBSERVATIONS <br /> This was a routine monitoring inspection of the 87.6 acre Thomas Gravel Pit#4. Eric Scott of DRMS met site <br /> operator Ray Thomas at the scale house and toured the site with him. The permit identification sign was <br /> present at the site entrance (photo 1). <br /> The site has not been actively mined for some time, and the affected area based on aerial photography of the <br /> site is approximately 52 acres. Mr. Thomas stated that material is still being utilized from the existing product <br /> stockpiles located on the floor of the affected area, but that the market for the material had slowed due to <br /> reduced oilfield activity in the area. <br /> Three issues requiring correction were identified during this inspection as summarized in the previous section <br /> of this report. The first issue is that the provided reclamation bond is no longer sufficient to complete the <br /> required reclamation as approved. The required increase is due primarily to the following conditions: the <br /> bond has not been adjusted since the permit was transferred from Weld County to the current permittee in <br /> 2010; the existing disturbance (approximately 52 acres) is well in excess of the 10 acre maximum currently <br /> allowed by the approved permit- as noted in the 2014 inspection; and approximately 12,500 cubic yards (1.3 <br /> acres approximately 2 yards high) of concrete has been imported into the permit area. This imported <br /> concrete is not part of the currently approved mining or reclamation plan, as was noted in the 2009 inspection <br /> of the site. The Division will recalculate the required reclamation bond based on conditions observed during <br /> this inspection and the approved reclamation plan. A surety increase will then be issued under separate <br /> cover. The operator will have 60 days from the date on the surety increase notice to post the additional <br /> financial warranty. <br /> The second issue is that a technical revision (TR) to the permit will be required to modify the permit to <br /> account for the amount of disturbance on site, and the importation and use/reclamation of the concrete now <br /> present on site (photos 5 and 6). This technical revision should be submitted to DRMS prior to the corrective <br /> action date listed above. <br /> Page 2 of 4 <br />
