PERMIT#: M-2010-055 <br /> INSPECTOR'S INITIALS:ECS <br /> INSPECTION DATE:January 23,2020 <br /> current mine plan, or submit a Technical Revision, with the required $216 revision fee, to update and clarify the <br /> current approved mine plan to reflect existing and proposed activities by the corrective action date. <br /> CORRECTIVE ACTION DUE DATE: 2/28/20 <br /> OBSERVATIONS <br /> This was a routine monitoring inspection of the 35 acre Konig Borrow Pit. Eric Scott of DRMS met site <br /> operator Joel Konig at the site entrance and toured the site with him. The permit identification sign was <br /> present at the site entrance and the boundary markers were in place (photo 1). GPS data was collected to <br /> confirm the placement of the permit boundary markers. The site has not been actively mined for some time, <br /> and the affected area remains 18 acres—similar to what was documented during the last monitoring <br /> inspection. Mr. Konig stated that material is still being utilized from the existing product stockpile, but that <br /> the market for the material had slowed due to reduced oilfield activity in the area. <br /> Two issues were identified during this inspection as summarized in the previous section of this report. The <br /> first issue noted was the presence of approximately 500 linear feet of highwall approximately 10' tall (photos 4 <br /> and 5). The approved mine plan for this site states that mining will be conducted at a 3:1 slope or flatter. The <br /> operator will need to either immediately slope the highwall to no steeper than 3:1 as approved in the current <br /> mine plan, or submit a Technical Revision, with the required $216 revision fee,to update and clarify the <br /> current approved mine plan to reflect existing and proposed activities by the corrective action date (2/28/20). <br /> The second issue is that the provided reclamation bond is no longer sufficient to complete the required <br /> reclamation as approved. This is due primarily to the fact that the bond has not been adjusted since the <br /> permit was approved in 2010. The Division will recalculate the required reclamation bond based on conditions <br /> observed during this inspection and the approved reclamation plan. A surety increase will then be issued <br /> under separate cover.
