Exhibit L—Reclamation Costs (Rule 6.4.12) <br /> 38. Please update the reclamation costs to incorporate the phasing of the CUP, if warranted. <br /> No mining or disturbance will occur outside the overlapped areas of the Huerfano County CUP <br /> and the proposed DRMS 112 permit boundary. The estimated bond was not affected by phasing <br /> of within the CUP boundary. <br /> Exhibit M—Other Permits and Licenses (Rule 6.4.13) <br /> 39. Please commit to providing a copy of all the permits that are in progress once they are <br /> approved. <br /> The Applicant commits to submitting all required permits to the DRMS as they are awarded. <br /> Exhibit S—Permanent Man-made Structures (Rule 6.4.19) <br /> 40. Please provide the notary page for the structure owners that have been received. Please <br /> indicate which structures where notary pages have not been received. <br /> Structure agreements were signed and notarized by the Operator and were delivered via certified <br /> mail to the Union Pacific Railroad, the BNSF Railway (returned), Margaret Meyer, Huerfano <br /> County Road and Bridge, David and Cindy Driscoll, the Huerfano-Cucharas Irrigation <br /> Company/Two Rivers Water and Farming Company, Carolina Potts, Edmundson Ranches <br /> (returned), and the Bureau of Land Management. All delivery addresses were discovered on the <br /> Huerfano County Assessor's website. Copies of the signed and notarized structure agreements <br /> are shown in Exhibit S. Additional structure agreements are now included for the wells within <br /> the 0.5 miles from the blasting radius detailed in the Preliminary Blast Plan in Appendix 3. <br /> 41. Please clarify if the underground water supply pipes were part of the structure <br /> agreements, if not please provide the structure agreement for them. <br /> An additional structure agreement was prepared, signed and notarized by the Operator, and <br /> delivered via certified mail to the property owner Edmundson Ranches detailing underground <br /> water supply pipe handling in areas within the planned mining area as well as areas adjacent to <br /> the permit boundary. See the agreement shown in Exhibit S. <br /> Rule 6.5 —Geotechnical Stability Exhibit <br /> 42. Rule 6.5(4) requires an operator who proposes blasting to provide an appropriate <br /> blasting, vibration, geotechnical and structural engineering analyses that off-site areas <br /> will not be adversely affected by blasting. While the Rules do not provide details of the <br /> exact type of analysis or demonstration that needs to be conducted, the DRMS Minerals <br /> program typically follows the protective standards accepted by the Office of Surface <br /> Mining, Reclamation and Enforcement for airblast and ground vibration.
