Townsend Ave. Montrose, CO 81401 Re: New Horizon North Mine (Permit No. C-2010-089) Technical Revision No. 23 (TR-23) Pond NHN-001 East Ditch Dear Montrose County Commissioners: The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on January 17, 2020 an application to revise coal mining operations at the New Horizon North Mine was considered complete for the purposes of filing. The revision was submitted by Elk Ridge Mining and Reclamation, LLC. All review and comment periods as provided in the Act and the Regulations initiate from this date of filing. ERMR is proposing to remove the east ditch liner in Segment 6 of the ditch. The applicant is not proposing additional surface disturbance outside of the area currently approved for disturbance. The surface coal mining operation is on land located approximately 2.5 miles Northwest of Nucla. The permit area is further described as follows: Portions of Sections 25 and 36, T 47 N, R 16 W, N.M.P.M. The above-mentioned tracts of land are shown on the following USGS 7.5 minute Quadrangle map(s): Nucla. The applicant is required to publish notice in a local newspaper that this application has been deemed complete. At the time of publication of this notice, the applicant is additionally required to place a copy of this application at the Montrose County Courthouse, 300 Main Street, Nucla, CO 81424, and at the Division office.
