Adequacy Review <br /> Hi Elliott, <br /> I've read through your Adequacy Review correspondence dated December 30, 2019 and the <br /> attachments, and have the following comments: <br /> 1. The Public Notice will be printed again in the Fairplay Flume this coming Friday, <br /> January 10, 2020 and shows the ten-day comment period ending January 20, 2020. Upon <br /> receipt, I will forward the Flume's acknowledgement correspondence which will show <br /> that the notice was published. <br /> 2. Division of Water Resources correspondence dated December 16, 2019: Exposure of <br /> ground water will not occur. Storm water will not be contained on the site. We do not <br /> anticipate the need for any water in the mining operation. However, should there be a <br /> need for water, we will confirm the legality of any proposed source of water with the <br /> Division of Water Resources prior to use in the operation. <br /> 3. Department of the Army - Corps of Engineers correspondence date stamped December <br /> 16, 2019: Applicant assures the Corps that there will be no discharge of dredged or fill <br /> material, or any excavation associated with this operation, either temporary or permanent <br /> in or affecting any waters of the United States. Further, the Applicant assures the Corps <br /> that there is no wetland area near the intended upland operation identified in the <br /> Application. <br /> 4. Office of Archaeology and Historical Preservation correspondence dated December 16, <br /> 2019: To my knowledge, no cultural resources exist within the proposed permit area. <br /> However, as the State Historic Preservation Office points out, should human remains be <br /> discovered during mining activities, I will comply with the requirements of any <br /> applicable State Law, and in particular CRS 24-80, Part 13. <br /> 5. Exhibit C, Question 17—Regarding the timing of seeding the reclaimed area, I agree with <br /> your position and will be seeding the reclaimed area during late fall and or early spring. <br /> With your assistance,the USFS identified a grass mix for this location called"Montane <br /> Grasses" which I will gladly use. As a side note,this mix looks like a perfect match. <br /> Page 1 of 2 <br />
