Box 68 <br /> A Free <br /> P P y Empire, CO 80438 <br /> Phone(303)569-3221 <br /> Fax(303)569-2830 <br /> January 7, 2020 <br /> RE: Climax Molybdenum Company, Henderson Operations, Permit No. M-1977-342, <br /> Amendment AM-07, Response to Public Comments <br /> On May 9, 2019, Climax Molybdenum Company — Henderson Operations (Henderson) submitted Permit <br /> No. M-1977-342 Amendment AM-07 to the Colorado Division of Reclamation, Mining, and Safety (DRMS). <br /> During the public comment period which began on June 11, 2019 and closed on July 31, 2019, DRMS <br /> received comments from two organizations; History Colorado and the Colorado Division of Water <br /> Resources. Both comment letters are attached for review. <br /> Henderson has reviewed the public comments received from History Colorado and the Colorado Division <br /> of Water Resources and, in a letter to DRMS on January 3, 2020, provided the following responses: <br /> To History Colorado: <br /> Henderson is aware of the cultural resources identified in the letter and will avoid <br /> disturbing these sites. If future mining activities lead to the discovery of unidentified <br /> cultural resources, Henderson will follow the requirements of CRS 24-80 Part 13 as <br /> requested. <br /> To the Colorado Division of Water Resources: <br /> Henderson acknowledges and agrees with the comments from Mr. Javier Vargas- <br /> Johnson from the Division of Water Resources. <br /> These responses have now been provided to Grand County for public viewing. <br />
