(Tri-State), SL-17 partial Phase I, II,and III bond release application. OSMRE <br /> agrees with the proposed decision and hereby provides concurrence in accordance with 30 CFR 740.15(d)(3)and <br /> 30 CFR 906.30, Article IX,Section 24 of the State-Federal Cooperative Agreement. <br /> This bond release action pertains to 0.4 acres associated with a portion of the South Collection Ditch which is <br /> permitted to remain as a permanent structure at the landowner's request.The surface and mineral ownership <br /> associated with this bond release is State (Colorado State Land Board,or CSLB).By letters dated October 24, <br /> 2019,DRMS invited the CSLB,Bureau of Land Management(BLM),and OSMRE to attend the bond release <br /> inspection on November 13ei.The CSLB,BLM,and OSMRE declined to attend.By letter dated December 27, <br /> 2019,BLM provided its concurrence with DRMS's proposed decision. OSMRE interprets this to mean Tri-State <br /> is in compliance with all stipulations associated with its federal coal leases. <br /> DRMS's proposed decision notes Tri-State's compliance with the approved Colorado regulatory program at Rules <br /> 3.03.1(2)(a)through(c)and recommends approving partial Phase 1, II,and III bond release on 0.4 acres at the <br /> Colowyo Mine.DRMS currently holds a performance bond in the amount of$108,025,721.00 which covers the <br /> entire permit area, including the acreage proposed for release.
