Summary <br /> Revisions to the Permit <br /> The following revisions have been submitted since the last midterm review of the Elk Creek <br /> Mine permit application package (PAP), (MT-7, 7/12/2018): <br /> Minor Revisions <br /> MR-110, Minor updates to PAP, submitted 4/23/2019, approved 5/1/2019 <br /> MR-111, Clarification to Reclamation Slopes and Pipeline Activities, submitted <br /> 7/8/2019, approved 7/9/2019 <br /> Technical Revisions <br /> TR-77, Revision to the revegetation plan, submitted 3/19/2019, approved <br /> 7/15/2019 <br /> Surety Releases <br /> SL-1, Partial Phase I Bond Release, submitted 2/27/2019, approved 10/18/2019 <br /> SL-2, Phase I, II and III Bond Release submitted 9/16/2019, under review <br /> Status of Stipulations <br /> The stipulation history for the Elk Creek Mine was reviewed with this renewal application. The <br /> review included an investigation of any stipulations imposed, and any responses to existing <br /> stipulations received since the last midterm review. All stipulations associated with this permit <br /> and issued over the life of this operation have been complied with or terminated. <br /> Enforcement Actions <br /> No enforcement actions have been issued since the last midterm review of the Elk Creek Mine <br /> PAP. <br /> The Review Process <br /> On January 30, 2018, the Division notified Oxbow Mining, LLC (OMLLC) that the five-year <br /> permit term for the Elk Creek Mine would expire on October 11, 2018 and that a permit renewal <br /> application must be submitted by April 14, 2018 to retain the right to successive renewal. <br /> OMLLC submitted an application for permit renewal 7 (RN-7), which was received by the <br /> Division on March 19, 2018. On March 22, 2018,the application was deemed Complete for <br /> purposes of filing. The public notice announcing the completeness of the permit renewal <br /> application was published in the Delta County Independent for four consecutive weeks beginning <br /> April 4, 2018 and ending April 25, 2018. No comments were received by the Division <br /> concerning the renewal. The Applicant Violator System (AVS) was queried for any non- <br /> compliance issues relating to OMLLC. The AVS report generated on December 23, 2019, <br /> revealed two outstanding violations associated with companies and permits within the corporate <br /> hierarchy in other states dating back to 1985, but no violations that impact permitting action in <br /> 4 <br />
