A. There is no approved concurrent surface and underground mining at the Elk Creek <br /> Mine, therefore this section does not apply (4.22.2) <br /> XVII. Operations on Alluvial Valley Floors <br /> A. The Division has determined that an alluvial valley floor exists in an adjacent area. <br /> Therefore, the following findings are in order for the alluvial valley floor that is <br /> located on the North Fork of the Gunnison River downstream from the mine site. <br /> 1. The Division finds that activities proposed by the applicant will not interrupt, <br /> discontinue, or preclude farming on the alluvial valley floors that are irrigated or <br /> naturally sub-irrigated (4.24.3(1)). <br /> 2. The proposed activities will not materially damage the quantity or quality of <br /> water in the surface or ground water system described above (4.24.3(3) and <br /> 2.06.8(5)(a)(ii)). <br /> 3. The proposed activities will comply with the requirements of the Act and the <br /> Regulations with respect to alluvial valley floors (2.06.8(5)(a)(iii)). <br /> 4. Surface coal mining and reclamation operations will be conducted to preserve <br /> the essential hydrologic functions of alluvial valley floors outside the permit area <br /> and to reestablish the essential hydrologic functions of alluvial valley floors <br /> within the affected area throughout the mining and reclamation process (4.24.2) <br /> XVIII. Operations on Prime Farmland <br /> A. The Division has not identified Prime Farmland within the permit area, therefore <br /> this section does not apply (4.25.2(3)). <br /> XIX. Mountaintop Removal <br /> A. The Division has not approved Mountaintop Removal mining methods, therefore <br /> this section does not apply (4.26.2(2)) <br /> XX. Operations on Steep Slopes <br /> A. The Division has not approved variances related to operations on steep slopes, <br /> therefore this section does not apply (4.27.2) <br /> XXI. In Situ Processing <br /> A. In-situ processing is not proposed, therefore this section does not apply <br /> 27 <br />
