C. Methods to measure herbaceous cover and production are discussed in Exhibit
2.05-E6 of the PAP. The methods follow those suggested in the Division Bond
Release Guideline, 1995. The Division has granted OMLLC's request for the
elimination of the woody stem density standard for the reclamation of the mine
site, based on landowners' requests. The Division has approved these techniques
(4.15.7(1)).
D. Comparisons between reclaimed and undisturbed areas, in order to demonstrate
that the success criteria of 4.15.8, 4.15.9, or 4.15.10 have been met, depend on the
approved post-mining land use of the reclaimed area, and whether the land was
disturbed before or after the passage of the Surface Mining Control and
Reclamation Act of 1977. Revegetation success criteria are described in detail in
Exhibit 2.05-E6 of the PAP, and are based on either: (i) a determination that
revegetation is unnecessary for erosion control and is not required; (ii) an estimate
of total live vegetative cover required to control erosion derived from the Revised
Universal Soil Loss Equation (RUSLE); or (iii) comparison of vegetative cover,
production and species diversity with an extended reference area.
The Division proposes to approve the basis for this comparison.
E. The Division proposes to approve of the reference areas, which the applicant has
selected based on the requirements of Rule 4.15.7(3).
F. The reference areas will be utilized to determine revegetation success in a manner
which the Division finds acceptable 4.15.7(4)).
G. The Division proposes to waive the woody plant density standard based on the
requests of the landowners, as recorded in letters attached to Exhibit 2.05-E6 of the
PAP (4.15.8(3) and (4)).
H. The Division proposes to waive the requirement to establish vegetative cover on an
area containing mine support facilities where the approved post-mining land use is
"Industrial or Commercial" since the waiver was requested by the landowner and
the Division has determined that revegetation is not necessary to control erosion
(4.15.10(3)).
XII. Post-mining Land Use
A. The post-mining land use for most of the permit area is Undeveloped Lands which
will be utilized for very limited grazing, dispersed wildlife habitat and recreational
uses. The land-use is consistent with the pre-mining land use.
Several parcels within the disturbed area have been approved for a post-mining
land use of"Industrial or Commercial", these parcels are shown on Map 2.05-M8
(sheets 1 and 2) of the PAP. The land-use meets the criteria of Rule 4.16.3.
25
