Henderson provided a status update to DRMS in a letter dated December <br /> 19, 2019 in support of our financial warranty and the path forward for resolving Item 9 in your August 12, <br /> 2019 Adequacy Review letter. It appears more time is needed to fully address the financial items specified <br /> in the Adequacy Review and, for this reason, Henderson is requesting an extension of 60 days to the <br /> decision date. <br /> Henderson has also reviewed the public comments received from History Colorado and the Colorado <br /> Division of Water Resources, which were included in your second adequacy review letter dated November <br /> 15, 2019, and provides the following responses: <br /> To History Colorado: <br /> Henderson is aware of the cultural resources identified in the letter and will avoid <br /> disturbing these sites. If future mining activities lead to the discovery of unidentified <br /> cultural resources, Henderson will follow the requirements of CRS 24-80 Part 13 as <br /> requested. <br /> To the Colorado Division of Water Resources: <br /> Henderson acknowledges and agrees with the comments from Mr. Javier Vargas- <br /> Johnson from the Division of Water Resources. <br /> These responses are also being provided to Grand and Clear Creek counties for public viewing and, once <br /> proof of record is obtained from the counties, this documentation will be sent to you under separate <br /> letterhead. <br />
