VALUATION OF SKYLARK RANCH WATER RIGHTS <br /> December 2019 <br /> 2.0 SKYLARK RANCH WATER RIGHTS <br /> In 1994, Climax acquired agricultural water rights located downstream from the <br /> Henderson Mill, referred to as the Skylark Ranch Water Rights. These include several <br /> direct flow water rights and one storage water right on tributaries of the Williams Fork <br /> River including Skylark Creek, Battle Creek, Lost Creek, and Mule Creek. The Skylark <br /> Ranch Water Rights are summarized in Table 2-1 and Table 2-2. <br /> In Case No. 96CW3681, the Skylark Ranch Water Rights were quantified and changed to <br /> include all beneficial uses, including augmentation, and use at the Henderson Mill by <br /> exchange. The water rights may also be used for irrigation of the historically irrigated <br /> lands. The terms and conditions in the 96CW3681 decree limit use of the Skylark Ranch <br /> Water Rights to monthly, annual, and 10-year running average volumes during a <br /> diversion season that extends from May 1 through September 30. There are additional <br /> limits that apply in drought years. In addition, 12.1 percent of the diversions under the <br /> Skylark Ranch Water Rights must be released uniformly during the following October 1 <br /> through April 30 period to replicate historical return flows during the non-irrigation <br /> season. The terms and conditions for the changed Skylark Ranch Water Rights are <br /> summarized in Table 2-1. A copy of the decree in Case No. 96CW3681 is attached as <br /> Appendix A to this report. <br /> The Skylark Ranch Water Rights can be diverted at the original points of diversion or by <br /> exchange at the following alternate points of diversion and storage. <br /> • Intake 1—Williams Fork Pipeline <br /> • Intake 2— Henderson Mill Potable Water Pipeline <br /> • Intake 3— Ute Creek Pipeline <br /> • Intake 4— Lower Ute Creek Intake <br /> • Intake 5— Lost Creek Intake <br /> • East Branch Reservoir <br /> • Ute Creek Reservoir <br /> • Lost Creek Reservoir <br /> Climax cannot divert the Skylark Ranch Water Rights at the alternate points of diversion <br /> when other water rights on the Williams Fork River between the original and alternate <br /> points of diversion are not satisfied.
