Shores Substitute Water Supply Plan <br /> December 18, 2019 <br /> Page 5 of 7 <br /> The Ditch Rights will continue to be diverted at the river headgate of the Rural Ditch, and ditch <br /> losses, as assessed by the Rural Ditch Company ditch rider, will remain in the ditch. For the months of October through April, the total delivery of the Ditch Rights for <br /> the prior 12 month period will be multiplied by the applicable monthly deep percolation return <br /> flow factor, then divided by the number of days in the month, to determine the daily return flow <br /> requirement. <br /> For purposes of this SWSP return flows will be owed to Saint Vrain Creek at a location in the SW <br /> 1/4 of the SE 1/4, Section 36, Township 3 North, Range 68 West, 6t" P.M. as shown on Figure 2. <br /> Conditions of Approval <br /> I approve the proposed substitute water supply plan in accordance with Section <br /> 37-90-137(11), C.R.S., subject to the following conditions: <br /> 1. This SWSP shall be valid for the period of January 1, 2020 through December 31, 2020, <br /> unless otherwise revoked, modified, or superseded by decree. If this plan will not be <br /> made absolute by a water court action by the plan's expiration date, a renewal request <br /> must be submitted to this office with the statutory fee (currently $257) by November 1, <br /> 2020. If a renewal request is received after the expiration date of this plan, it will be <br /> considered a request for a new SWSP and the $1,593 filing fee will apply. <br /> 2. Well permit no. 61716-F was obtained for the current use and exposed pond surface area <br /> of the gravel pit in accordance with 537-90-137(2) and (11), C.R.S. <br /> 3. The total surface area of the groundwater exposed at the Shores Pit must not exceed 11 <br /> acres in the silt pond and 3.5 acres of open water surface during the approval period of <br /> this SWSP resulting in an annual evaporative loss of 37.99 acre-feet. <br /> 4. The annual amount of water used at the operation shall not exceed 1.66 acre-feet for dust <br /> control and the amount used for concrete batching shall not exceed 1.64 acre-feet used in <br /> the production of 105,000 cubic yards of concrete. <br /> 5. Total consumption at the Shores Pit must not exceed the aforementioned amounts unless <br /> an amendment is made to this plan. <br /> 6. If mining occurs during this plan period, mining may only occur within lined Pond A. If <br /> mining occurs outside of the lined Ponds an amendment must be made to this plan to <br /> account for water lost in mined product. <br /> 7. Approval of this plan is for the purposes as stated herein. Any additional uses of this water <br />
