The Ditch Rights will continue to be diverted at the river headgate of the Rural Ditch, and ditch
losses, as assessed by the Rural Ditch Company ditch rider, will remain in the ditch. Deliveries
from the Rural Ditch will be delivered to Pond E where it will be released to replace depletions
and return flow requirements under this SWSR
The Return Flow Factors are shown in Table 5 below.

For the months of April through October the return flows will be calculated by multiplying the
daily total delivery of the Ditch Rights by the applicable monthly surface return flows factor in
Table 5 above. For the months of October through April, the total delivery of the Ditch Rights for
the prior 12 month period will be multiplied by the applicable monthly deep percolation return
flow factor, then divided by the number of days in the month, to determine the daily return flow
requirement.
For purposes of this SWSP return flows will be owed to Saint Vrain Creek at a location in the SW
1/4 of the SE 1/4, Section 36, Township 3 North, Range 68 West, 6t" P.M. as shown on Figure 2.
Conditions of Approval
I approve the proposed substitute water supply plan in accordance with Section
37-90-137(11), C.R.S., subject to the following conditions:
1. This SWSP shall be valid for the period of January 1, 2020 through December 31, 2020,
unless otherwise revoked, modified, or superseded by decree. If this plan will not be
made absolute by a water court action by the plan's expiration date, a renewal request
must be submitted to this office with the statutory fee (currently $257) by November 1,
2020. If a renewal request is received after the expiration date of this plan, it will be
considered a request for a new SWSP and the $1,593 filing fee will apply.
2. Well permit no. 61716-F was obtained for the current use and exposed pond surface area
of the gravel pit in accordance with 537-90-137(2) and (11), C.R.S.
3. The total surface area of the groundwater exposed at the Shores Pit must not exceed 11
acres in the silt pond and 3.5 acres of open water surface during the approval period of
this SWSP resulting in an annual evaporative loss of 37.99 acre-feet.
4. The annual amount of water used at the operation shall not exceed 1.66 acre-feet for dust
control and the amount used for concrete batching shall not exceed 1.64 acre-feet used in
the production of 105,000 cubic yards of concrete.
5. Total consumption at the Shores Pit must not exceed the aforementioned amounts unless
an amendment is made to this plan.
6. If mining occurs during this plan period, mining may only occur within lined Pond A. If
mining occurs outside of the lined Ponds an amendment must be made to this plan to
account for water lost in mined product.
