Water District 5, Weld County <br /> SWSP Plan Id: 3609 <br /> Approval Period: January 1, 2020 through December 31, 2020 <br /> Contact phone number for Mr. Andy Rodriguez: 303-833-1416 <br /> Dear Mr. Rodriguez: <br /> We have reviewed your letter dated September 27, 2019, requesting renewal of the <br /> above-referenced substitute water supply plan to cover depletions at the Shores Sand Et Gravel <br /> mine, operated by Bestway Concrete Et Aggregate ("Applicant"). The required fee of $257.00 for <br /> the renewal of this substitute water supply plan has been submitted (receipt no. 3694050). The <br /> original plan was approved on May 21, 2001 and was most recently approved on March 14, 2019 for <br /> operations through December 31, 2019. <br /> Plan Operation <br /> This plan seeks to replace depletions resulting from mining operations at the Shores gravel pit. <br /> The site contains five slurry walled areas, designated pits A through E, as shown on the attached <br /> Figure 1. Together these five cells are planned to eventually be connected via pipelines, by <br /> others, and become Shores Lake (WDID 0503900) as adjudicated in case no. 2000CW83. Pits A, B, <br /> C, D and E were initially dewatered and dry mined. A slurry wall was constructed around pits A <br /> and B and lining for these cells was approved on January 11, 2007. A slurry wall was constructed <br /> around pit C and was approved on December 7, 2009. A slurry wall was constructed around pit D <br /> and was approved on October 8, 2013. A slurry wall was constructed around pit E and was <br /> approved on June 23, 2017. Mining has stopped in Pits A and E. The depletions that result from <br /> mining operations at the Shores pit are evaporation from a silt pond and open surface water <br /> surrounding Pond E, concrete batching, dust suppression and dewatering lagged depletions. The <br /> proposed replacement sources are 1.3 shares of the Rural Ditch and water stored in Pond E during <br /> free river. <br /> In accordance with the letter dated April 30, 2010 (copy attached) from the Colorado Division of <br /> Reclamation, Mining, and Safety ("DRMS"), all sand and gravel mining operators must comply with <br /> the requirements of the Colorado Reclamation Act and the Mineral Rules and Regulations for the <br /> protection of water resources. The April 30, 2010 letter from DRMS requires that you provide <br /> information to DRMS to demonstrate you can replace long term injurious stream depletions that <br /> result from mining related exposure of groundwater.
