A five-year lease dated August 1, 2017 was obtained to provide replacement supplies during this SWSP approval period from the Upper Arkansas Water Conservancy District ("UAWCD"). The minimum and maximum amounts of leased water for each year of the agreement are shown in the table, below: . . 1 1' The Colorado Water Protective and Development Association ("CWPDA") has confirmed that they will make 30 acre-feet available to Valco for use in this Plan. Valco owned two shares in the Rocky Ford Ditch, which have been transferred to Deep Cut. However, these shares may result in consumptive use credits in excess of what Deep Cut required for this season. Valco may, with approval from Deep Cut and the Division Engineer, use a portion of those shares as part of its SWSP replacement requirement. CONDITIONS OF APPROVAL I hereby approve the proposed SWSP in accordance with Section 37-90-137(11), C.R.S., subject to the following conditions: 1. This SWSP shall be valid for the period of November 1, 2019 through October 31, 2021, unless otherwise revoked or superseded by decree. If this SWSP will not be made absolute by a water court action by the SWSP expiration date, a renewal request must be submitted to this office and the Division 2 office (please copy Kathy Trask at Kathy.TraskCstate.co.us and Bethany.Arnold Cstate.co.us) with the statutory fee per gravel pit (currently $257) by September 1, 2021. 2. No more than 15.3 acres of groundwater may be exposed at the Rocky Ford East Pit during the approval period of this SWSP without first obtaining a new SWSR Documentation of pond sizes may be required by the Division Engineer in the form of an aerial photo evaluation or survey by a Professional Land Surveyor during the plan year. 3. Subject to approval by the Division Engineer, the Applicant may lease or purchase additional replacement water from the sources approved in this plan. In addition, the Applicant must also provide a copy of a lease/purchase agreement to the State Engineer's Office and the Division Engineer for use of such additional replacement water.
