Mr. Paul Bruss, P.E. <br /> December 19, 2019 <br /> Page 3 of 5 <br /> REPLACEMENTS <br /> Valco will continue to utilize a combination of leased water and historical ditch credits to make <br /> replacements to the river. A five-year lease dated August 1, 2017 was obtained to provide <br /> replacement supplies during this SWSP approval period from the Upper Arkansas Water Conservancy <br /> District ("UAWCD"). The minimum and maximum amounts of leased water for each year of the <br /> agreement are shown in the table, below: <br /> . . 1 <br /> 1' <br /> The Colorado Water Protective and Development Association ("CWPDA") has confirmed that they will <br /> make 30 acre-feet available to Valco for use in this Plan. <br /> Valco owned two shares in the Rocky Ford Ditch, which have been transferred to Deep Cut. However, <br /> these shares may result in consumptive use credits in excess of what Deep Cut required for this <br /> season. Valco may, with approval from Deep Cut and the Division Engineer, use a portion of those <br /> shares as part of its SWSP replacement requirement. <br /> CONDITIONS OF APPROVAL <br /> I hereby approve the proposed SWSP in accordance with Section 37-90-137(11), C.R.S., subject to the <br /> following conditions: <br /> 1. This SWSP shall be valid for the period of November 1, 2019 through October 31, 2021, unless <br /> otherwise revoked or superseded by decree. If this SWSP will not be made absolute by a water <br /> court action by the SWSP expiration date, a renewal request must be submitted to this office <br /> and the Division 2 office (please copy Kathy Trask at Kathy.TraskCstate.co.us and <br /> Bethany.Arnold Cstate.co.us) with the statutory fee per gravel pit (currently $257) by <br /> September 1, 2021. <br /> 2. No more than 15.3 acres of groundwater may be exposed at the Rocky Ford East Pit during the <br /> approval period of this SWSP without first obtaining a new SWSR Documentation of pond sizes <br /> may be required by the Division Engineer in the form of an aerial photo evaluation or survey <br /> by a Professional Land Surveyor during the plan year. <br /> 3. Subject to approval by the Division Engineer, the Applicant may lease or purchase additional <br /> replacement water from the sources approved in this plan. In addition, the Applicant must <br /> also provide a copy of a lease/purchase agreement to the State Engineer's Office and the <br /> Division Engineer for use of such additional replacement water. <br />
