December 16, 2019
Colorado Division of Reclamation,
Mining&Safety
1313 Sherman St, Room 215
Denver, CO 80203
Dear Elliott Russell:
This letter will address numbers 5, 6 and 7 of your adequacy review. As
stated previously the existing disturbance was done in the 1940's and
1950's. All I have done is dug bench diggings going into the disturbance.
Because of the dirt buildup I need to manage the fill they dig out. That
is the reason for this update. There are pit diggings and these will
discouraged and filled, there is a hill of fill from the 50's that people are
digging in and throwing the dirt behind them. They are in fact leveling
and helping the erosion situation.
I need this permit so I can get equipment on the claim to build a
diversion berm keeping storm water out of the claim. By having a
machine I can level the ground and keep erosion to a minimum, I will
remediate areas right behind as we dig. Straw bales and wattles will be
used to control extreme runoff. There is no stream or body of water to
get sedimentation in it because live water is two miles away. I intend to
stay in the 4.1 acre area entirely. Please note this is BLM land and
people will be pot holing around my claim, I have no control over them.
Sincerely,
David Harvey (CBRG)
