December 16, 2019 <br /> Colorado Division of Reclamation, <br /> Mining&Safety <br /> 1313 Sherman St, Room 215 <br /> Denver, CO 80203 <br /> Dear Elliott Russell: <br /> This letter will address numbers 5, 6 and 7 of your adequacy review. As <br /> stated previously the existing disturbance was done in the 1940's and <br /> 1950's. All I have done is dug bench diggings going into the disturbance. <br /> Because of the dirt buildup I need to manage the fill they dig out. That <br /> is the reason for this update. There are pit diggings and these will <br /> discouraged and filled, there is a hill of fill from the 50's that people are <br /> digging in and throwing the dirt behind them. They are in fact leveling <br /> and helping the erosion situation. <br /> I need this permit so I can get equipment on the claim to build a <br /> diversion berm keeping storm water out of the claim. By having a <br /> machine I can level the ground and keep erosion to a minimum, I will <br /> remediate areas right behind as we dig. Straw bales and wattles will be <br /> used to control extreme runoff. There is no stream or body of water to <br /> get sedimentation in it because live water is two miles away. I intend to <br /> stay in the 4.1 acre area entirely.
