In order to for AM02 to be issued,the required performance and financial warranties must be <br /> posted and approved by the Division within 365 days of the approval date. Pursuant to the Act no permit <br /> may be issued until the Board or Office receives and approves the performance and financial warranties <br /> As of this date, our records indicate that you have not posted the required Financial Warranty and Performance <br /> Warranty for AM02, and more than 365 days have passed since permit revision AM02 was approved by the <br /> Division. At this time, you will need to be scheduled for a Formal Board Hearing in accordance with the <br /> notification and comment provisions of Rule 1.6 for Board reconsideration of the Division's previous approval of <br /> AM02. <br /> In order for the Board to reconsider approval of your permit amendment beyond the 365 day deadline,you will <br /> need to re-notice everyone in accordance with Rule 1.6.2,just as you did initially for AM02. This means as soon <br /> as practically possible you will need to: <br /> 1) Re-notice the Larimer County Commissioners and local Soil Conservation Service per rule 1.6.2(1)(a) <br /> 2) Re-post the amendment applied for sign at the permit entrance per rule 1.6.2(1)(b) <br /> 3) Place the final amendment application with all adequacy comments and responses with the Larimer <br /> County Clerk and Recorder for public review per rule 1.6.2(1)(c) <br /> 4) Re-publish public notice of the amendment in the paper with a new public comment deadline per rule <br /> 1.6.2(1)(d) <br /> 5) Re-notice all affected area property owners and property owners within 200 feet of the permit boundary <br /> per rule 1.6.2(1)(e) <br /> You must provide proof of publication, and all above required notices,to the Division before the Division sets <br /> this matter before the Board for reconsideration of approval of the amendment. <br /> of o <br /> 1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us <br /> Jared Potis, Governor ( Dan Gibbs, Executive Director I Virginia Brannon, Director <br />
