("NCCI" or"Applicant"). The required fee of$257.00 for the renewal <br /> of this substitute supply plan ("SWSP") has been submitted (receipt no. 3695597). The original supply plan <br /> was approved on December 30, 2002 and the SWSP was most recently renewed on February 21, 2019. <br /> Plan Operation <br /> Mining operations at the NCCI Pit # 1 have ceased. This plan seeks to replace lagged depletions <br /> resulting from past mining operations at the NCCI Pit #1, evaporative losses and depletions from <br /> ongoing dewateri ng. In 2020, the mining operation will consist of 5.96 acres of exposed water surface <br /> area through recharge ditches, sedimentation ponds and dewatering ditches, as shown on attached <br /> Figure 1. <br /> The lagged depletions will be replaced using fully consumable effluent leased from the City of <br /> Thornton ("Thornton"). The NCCI Pit#1 will be lined. <br /> In accordance with the letter dated April 30, 2010 (copy attached) from the Colorado Division of <br /> Reclamation, Mining, and Safety ("DRMS"), all sand and gravel mining operators must comply with the <br /> requirements of the Colorado Reclamation Act and the Mineral Rules and Regulations for the protection <br /> of water resources. The April 30, 2010 letter from DRMS requires that you provide information to DRMS <br /> to demonstrate you can replace long term injurious stream depletions that result from mining related <br /> exposure of ground water. The DRMS letter identifies four approaches to satisfy this requirement. In <br /> accordance with approach no. 3, you have indicated that a bond has been obtained for $1,030,074 that <br /> can cover the cost of lining the NCCI Pit#1 to prevent the exposure of ground water. <br /> Depletions <br /> The exposed ground water surface area is 5.96 acres.
