Box 1488 <br /> Paonia, CO 81428 <br /> Re: Bowie No. 2 Mine,Permit C-1996-083, <br /> Review of Waste Bank Inspection Report,3ra Quarter 2019 <br /> Dear Mr. Bear: <br /> The Division received the Bowie No. 2 Mine Waste Bank Inspection Report for the 3rd quarter of <br /> 2019 on October 23, 2019. We reviewed this report in the context of the following rules: <br /> 1. 4.09.1(1 1)(a)—The fill was inspected for stability by a registered engineer during the compaction <br /> of fill materials. No placement occurred during the third quarter. <br /> 2. 4.09.1(1 1)(b)—A qualified registered engineer provided to the Division a certified report; <br /> however, submittal was not within two weeks after the inspection of the waste bank was <br /> completed. Due to HBETs servers being hacked,per the report, it took several days to restore <br /> files associated with this report. The Division accepts this explanation of the timing of the <br /> submittal. <br /> 3. 4.09.1(1 1)(c)—This rule is not applicable during this phase of construction. <br /> 4. 4.10.2—All criteria for Rule 4.10.2 were met. <br /> The Division is providing the following additional notes regarding this report. <br /> • As requested by the Division, BRL has provided a discussion of the seeps at Gob Pile#2. <br /> • Cleaning has been suggested on the upper diversion ditch at Gob Pile #3 during <br /> 2019. This maintenance item was also noted in the 2nd Quarter Waste Bank <br /> Inspection Report as well and should be completed as soon as practical. <br /> • Inclinometer readings were provided for Gob Pile #2. As stated in the 2nd quarter report, <br /> displacement was noted within inclinometer BG05-05 in a direction perpendicular to the <br /> slope. This displacement was detected in the 3rd quarter as well, deeper in the gob pile. <br /> However, displacement was not detected in the downslope direction, suggesting that error <br /> (possibly in recording or with the instrument) could be the cause of the displacement <br /> perpendicular to the slope.
