In conversations with <br /> DRMS as well as the response provided, you stated that completion of the work approved under the NOI <br /> has been delayed due to various legal actions required to clarify ownership and access to the property <br /> that contains the NOI. You also state that you are still waiting for a final judgement in on-going legal <br /> matters that will determine the status of property ownership and access for the area that contains the <br /> NOI, and that it is currently unknown when this decision will be rendered. <br /> Rule 5.1.2(J) states that modifications to an existing NOI must be submitted in writing and approved in <br /> advance of such activity. Modifications shall be reviewed by the Board or Office in the same manner as <br /> new NOIs... <br /> Rule 5.1.2(d)(vi)requires that NOI applicants provide documentation of the legal right to enter to <br /> conduct prospecting and reclamation, for Owners of Record described in Rule 1.6.2(1)(e)(i). This may <br /> include a copy of a lease, deed, abstract of title, a current tax receipt, or a signed statement by the <br /> Landowner(s) and acknowledged by a Notary Public stating that the Prospector has legal right to enter to <br /> conduct prospecting and reclamation. <br /> In accordance with the requirements referenced above please provide documentation of the legal right <br /> to enter to conduct prospecting and reclamation as required by Rule 5.1.2(d)(vi) <br /> You also provided the Division with a list of activities conducted to-date since the NOI was issued in <br /> 2008, and at least a partial list of activities that remain to be conducted to carry out the work approved <br /> under the initial NOI. You stated that this "project could easily take an additional 5 years." <br /> Rule 5.1.2(e) requires the approximate date of anticipated commencement and the date of completion of <br /> the above described prospecting activity. Such activity must be completed within five (5) years of the <br /> NOI approval unless otherwise approved by the Office or Board...
