This procedure <br /> will be repeated over the Term such that cattle will be able to graze all areas of the Property not <br /> within the then Fenced Sections. Exhibit D attached hereto shows the areas to be fenced <br /> outlined in blue, and the anticipated time periods when the Fenced Sections will be fenced to <br /> preclude cattle grazing. The time periods when the various Fenced Sections actually are fenced <br /> and unavailable for cattle grazing as shown on Exhibit D are subject to change based on the <br /> actual rate of mining. Tenant will give Landlord reasonable notice before new areas become <br /> unavailable, and when revegetated areas are again available for grazing. Tenant will incur all <br /> costs for the fencing. Landlord will be responsible for the safety of its cattle and will notify <br /> Tenant of any areas where fences need to be repaired. <br /> S. Miscellaneous. This Amendment may be executed in counterparts and via electronic <br /> delivery, each of which will, for all purposes be deemed an original, and all of which shall be <br /> identical. No provisions of the Lease are modified except as expressly set forth in this <br /> Amendment.
