Ton means 2000 pounds. Ton shall be determined by Colorado State certified <br /> scales or other methods approved by Lessor. <br /> Measurements It is agreed that all ores, minerals and other materials mined and taken <br /> from the Leased Premises shall be recorded by the counting of truckloads of mined <br /> material leaving the site and shall be entered in due form in the records kept for such <br /> purposes by Lessee. <br /> Yard - shalt mean loose cubic yard after extraction from the pit and before <br /> washing unless otherwise stated. If yard is measured in the pit it shalt be bank <br /> cubic yard and adjusted with an appropriate bulking factor. <br /> 13. STEWARDSHIP TRUST STIPULATION This section is deleted. <br /> 14. MINING METHODS -- Only mining methods that will insure the extraction of the greatest <br /> possible amount of minerals consistent within the laws and with prevailing good mining <br /> practice shall be used. <br /> 15. OPERATION PLAN -- Lessee shall follow the existing Colorado Division of Reclamation, <br /> Mining and Safety ("DRMS") approved mining plan. All new and revised plans for <br /> exploration and mining shalt be submitted to Lessor for approval by Lessor before or in <br /> conjunction with submittals to the DRMS. <br /> i <br /> i <br /> 16. ENVIRONMENTAL ANALYSIS -- Lessee shall comply with all applicable federal, state, <br /> and local taws, rules, regulations, permits, codes and ordinances, including the rules, <br /> regulations and requirements of the DRMS to identify and reduce adverse impacts to <br /> the environment, and the public health, safety and welfare. <br /> 17. RECLAMATION -- Lessee shalt reclaim the Leased Premises per the approved DRMS mining <br /> plan. All new and revised plans shall be submitted to Lessor for review before or in <br /> conjunction with submittals to the DRMS. Rules and regulations as set forth by the <br /> Division of Reclamation, Mining, and Safety for recovery and restoration of mined land <br /> will apply where applicable to the Leased Premises. <br /> 18. LESSOR'S APPROVAL -- Whenever approval by Lessor is required or contemplated by i <br /> Lessee, approval must be in writing and shall be within the sole and absolute discretion I <br /> of Lessor. <br /> 19. OTHER STATE AGENCIES -- Lessor may determine that instruments and documents <br /> required by other State agencies satisfy certain requirements of this Lease. In the event <br /> that Lessee is required to file instruments and documents with other State agencies, I <br /> including the Division of Reclamation, Mining, and Safety, Lessee shalt notify Lessor of <br /> said filing and Lessor reserves the right to request and obtain copies of such instruments j <br /> and documents from the agency or from Lessee. <br /> 20. INSPECTION -- It is agreed that during all proper hours and at all times during the <br /> continuance of this Lease, Lessor or Lessor's duly authorized agent, is authorized to <br /> check assays and scales as to their accuracy, to go through or on any part or all of the <br /> I <br /> Page 6 of 13 <br />
