r <br /> The state board, department, or agency owning or occupying said public lands is afforded <br /> the same Scheduling and Hearing protections as provided landowners or occupants of <br /> private lands under Sections 603 and 604 of this Policy. <br /> PART 8 <br /> MISCELLANEOUS <br /> ( <br /> Section 801. Additional provisions <br /> (1) It is the Weed Office's responsibility through reasonable efforts to determine <br /> whether the property with a suspected noxious weed infestation is occupied by an <br /> individual other than the landowner. <br /> (a) Reasonable efforts to determine the identity of the tenant and/or occupant <br /> may include one or more of the following: <br /> (i) mailing a copy of the notice to any dwelling on the real property, <br /> (ii) contacting the Farm Service Agency("FSA"), <br /> (iii) asking the landowner for the identity of any tenant and/or occupant <br /> on the real property, <br /> (b) any reasonable efforts taken by the Weed Office should be <br /> documented. <br /> (c) If the Weed Office determines an individual(s) other than the landowner <br /> occupies the property, any and all applicable Notices should be sent to both <br /> landowner and occupant. <br /> (d) If the Weed Office determines an individual(s) other than the landowner <br /> occupies the property, any and all applicable Orders approved by the local <br /> governing body should be sent to both landowner and occupant. <br /> (2) The local governing body,through its delegates, agents, and employees, shall have <br /> the right to enter upon any premises, lands or places,whether public or private, <br /> during reasonable business hours for the purposes of ensuring compliance with any <br /> of the above requirements concerning noxious weed management and any other <br /> local requirements.' <br /> (3) No agent, employee, or delegate of the local governing <br /> body shall have a civil cause of action against a <br /> landowner or occupant for personal injury or property <br /> damage incurred while on public or private land for <br /> purposes consistent with the above requirements <br /> Id.at(6) <br /> 23 <br />
