Fox Engineering Solutions has been requested by Mr. Fontanari to follow-up with your request for a
Weed Management Plan. It is our understanding that your office issued a Corrective Action, based on a
field inspection of August 8, 2019.
As noted in the inspection report, several noxious weeds were observed throughout the site.Although
cheatgrass is a pervasive noxious weed throughout western Colorado, Knapweed, Halogeton, Kochia,
Russian Thistle, and Alyssum were also identified. To aid in our efforts to comply with your request, can
your office provide specific locations or areas within the permit area where these weeds were noted.
We reviewed the inspection report photographs and could not ascertain the areas.
Also noted in the Corrective Action, "Implement approved weed control plan and provide proof to the Division that
this has been done. If a weed control plan is not already in place, the operator shall develop a weed control and
management plan in accordance with Section 3.1.10(6) of the Rule." This request is similar to the revegetation plan
request for the irrigation pipeline and ditch lateral removal project required by your office. In this case, there was an
existing revegetation plan in effect and any changes to that plan would have invoked a technical amendment subject
to fees and additional review by your agency.
We believe, as in the case of the original revegetation plan that a weed management plan, may already exist. It is the
desire of my client to follow up weed management activities under the original weed management plan approved
when the mining permit was issued. We are requesting a copy of the original weed management plan issued under
the original permit from your office.
Thank you for your assistance. If you have any questions let me know.
Respectfully submitted,
David Fox, P.E.
Fox Engineering Solutions, Inc.
P.O. Box 413
Fruita, CO 81521
Ph: (970) 250-5505
Email:coloradofox@bresnan.net
