Interoffice Memorandum <br />To: Janet Binns <br />From: Rob Zuber leoZ <br />Date: November 15, 2019 <br />Subject: New Horizon Mine (C-1981-08), TR -93 adequacy review <br />Janet, <br />I have reviewed the submittal from Elk Ridge Mining and Reclamation (owned by Tri-State) for <br />TR -93, which proposes to convert a sediment pond (Pond 009) on site to a stock pond (SP2). <br />Regarding Division requirements, this proposed action would be equal to removing the <br />sediment pond entirely because the smaller stock pond would not function as the sediment <br />pond was designed. Therefore, all of the area draining to Pond 009 (sub -basin) must have been <br />Phase II released (see Rule 3.03.1(5)). 1 looked at bond release documents and determined that <br />all of the sub -basin for this pond was indeed Phase II released with SL -15. <br />also looked at the revised PAP pages and revised design for SP2, Map 2.05.3(3)-39. <br />do not have any adequacy items for this TR.
