The Board Chair's ruling on any such motion shall constitute a ruling of <br /> the Board. <br /> Board Chair John Singletary, having reviewed Applicant's Motion, and being <br /> fully apprised of the issues, enters the following order granting the Motion. <br /> FINDINGS of FACT <br /> 1. Applicant filed a 112e amendment application with the Division o <br /> Reclamation, Mining and Safety "Division" on June 10, 2019 file number IVY-20 1 - <br /> e1, AM01 ("Application"). <br /> 2. On October 31, 2019, the Board held a prehearing conference through <br /> prehearing officer Jason Musick and pursuant to Rule 2.7 of the Minerals Rules and <br /> Regulations of the Colorado Mined Land Reclamation Board for the Extraction of <br /> Construction Materials ("Rules"). The Applicant and three objectors attended the <br /> prehearing conference. <br /> 3. During the October 31, 2019 prehearing conference, and pursuant to <br /> Rule 2. 2 , the Applicant, objectors, and the Division provided witness lists, exhibit <br /> lists, and exhibits. objector Morgan County Quality Water District provided, <br /> among others, two exhibits that are the subject of Applicant's Motion. <br /> . 'those two exhibits, Exhibits 17 and 18 on Morgan County Quality <br /> Water District's exhibit list, contain information Applicant designated as <br /> confidential during the application process. <br />
