Where such structure is a utility, the Applicant may supply a notarized <br /> letter, on utility letterhead, from the owner(s) of the utility that the mining and <br /> reclamation activities, as proposed, will have "no negative effect" on their utility. <br /> If executed agreements cannot be obtained from all structure owners, a geotechnical <br /> stability analysis will need to be conducted to determine the required minimum <br /> setback distance to achieve the appropriate factor of safety (see item 30.0-Factors <br /> of Safety for Slope Stability/Geotechnical Analyses listed under the Policies of the <br /> Mined Land Reclamation Board on the DRMS website for discussion on the <br /> appropriate factor of safety). The geotechnical analysis and all supporting data and <br /> assumptions will need to be provided to DRMS for review and approval. <br /> Requests to execute notarized agreements between the permittee and all <br /> owners of Permanent Man-Made structures were made by certified mail(see <br /> Attachment E). Responses were received from Little Thompson Water District <br /> (LTWD) and Poudre Valley REA. The LTWD provided a notarized letter <br /> (enclosed) stating the proposed Mining and Reclamation will have no negative <br /> impacts on LTWD facilities. Poudre Valley REA (PVREA) indicated they will be <br /> willing to execute an agreement, which is currently in process.
