RIGHT OF ENTRY <br /> ir <br /> THIS RIGHT OF ENTRY is granted this J S day of Ochba , <br /> 2019, by and between City of Thornton, a Colorado home rule municipality, located <br /> at 9500 Civic Center Drive, Thornton, CO 80229 ("Thornton" or "Landowner") <br /> owner of property located at approximately 168th Avenue and Tucson Street, as <br /> shown at Assessor Parcel No. 0157101002001 of the Adams County public <br /> records, located in Section 1, Township 1 South, Range 67 West of the 6t" P.M. <br /> and Aggregate Industries-WCR, Inc., a Colorado corporation, located at 1687 Cole <br /> Blvd., Suite 300, Golden, CO 80401 ("Aggregate") (who may be referred to <br /> individually as a "Party" or collectively the "Parties"), for the purposes of performing <br /> land surveys, soils testing, environmental and archaeological assessments, real <br /> estate appraisals, utility locates and similar work (the "Work"). <br /> 1. Landowner represents that they own the Property and have the <br /> authority to make this grant of Right of Entry. <br /> 2. Landowner grants to Aggregate, its employees, agents, contractors, <br /> consultants and representatives, the right to enter upon the Property for the <br /> purposes of performing the Work. <br /> 3. The activities of Aggregate, its employees, agents, consultants and <br /> representatives will be coordinated with Landowner and Landowner's tenant so as <br /> not to unreasonably interfere with Landowner or Landowner's tenant's activities. <br /> 4. Aggregate shall be responsible for all costs associated with the Work <br /> and this Right of Entry. <br /> 5. Aggregate agrees to require agents, contractors and consultants <br /> hired by Aggregate to do Work on the Property to obtain and maintain Commercial <br /> General Liability insurance in the minimum amount of $1,000,000.00. <br /> 6. As a condition of the granting of this Right of Entry Aggregate <br /> covenants and agrees to restore the Property to a level comparable to the <br /> condition of the Property prior to Aggregate undertaking the Work. <br /> 7. The Parties hereto agree that neither has made or authorized any <br /> agreement with respect to the subject matter of this instrument other than <br /> expressly set forth herein and no oral representation, promise or consideration <br /> different from the terms herein contained shall be binding on either Party or its <br /> agents or employees hereto. <br /> 8. This Right of Entry shall inure to the benefit of, and be binding upon, <br /> the Parties, their respective legal representative, successors, heirs, and assigns. <br />
