On September 6, 2019 Henderson responded with a Waiver of Decision <br /> and Request for Additional Time to address several items that needed follow-up. DRMS approved <br /> Henderson's request and moved their decision date to November 8, 2019. Henderson has made efforts to <br /> respond to the requirements of the Adequacy Review, however, Henderson is in continuing discussions <br /> with the Division related to the reclamation costs and has an in-person meeting with DRMS for November <br /> 7, 2019. It is likely that, whatever the outcome of this meeting, Henderson will not be able to meet the <br /> requirements of this Adequacy Review request within the deadline of November 8, 2019. At this time <br /> Henderson is requesting a waiver of our right to a decision by November 8, 2019 and requests an extension <br /> of 60 days to the decision date. <br /> Please find attached the documentation in compliance with the other requirements in your AM-07 Adequacy <br /> Review Letter, as detailed below (DRMS comments are italicized): <br /> 6.4.3 Exhibit C— Pre-mining and Mining Plan Maps of Affected Lands <br /> 4. Pursuant to Rule 6.2.1(2)(b) maps must be prepared and signed by a registered land surveyor, <br /> professional engineer, or other qualified person. Please provide a signed copy of the Exhibit C <br /> Map. <br /> Exhibit C maps have been updated with a signature block which meets the requirements of Rule 6.2.1(2)(b). <br /> Aaron Hilshorst, the Chief Environmental Engineer for Henderson, has signed all maps in the capacity of a <br /> qualified person. <br /> 5. The proposed Mine Site addition and reconciliation areas are not clearly identified on the Mining <br /> Plan Map. Please revise the Exhibit C map to indicate the 1.3 acre Mine Site addition and the <br /> 48.3[acre]Mine Site reconciliation area. <br /> Exhibit C maps have been improved to include the requested acreage. Maps Exhibit C, Exhibit C.A, and <br /> Exhibit C.B include an aqua colored area called "'Reconciled' AM-07 Acreage" clearly identifying these <br /> areas. <br />
