November 8, 2019 and Request for Additional Time
Dear Mr. Hays:
Climax Molybdenum Company — Henderson Operations (Henderson) received your AM-07 Adequacy
Review letter on August 12, 2019. On September 6, 2019 Henderson responded with a Waiver of Decision
and Request for Additional Time to address several items that needed follow-up. DRMS approved
Henderson's request and moved their decision date to November 8, 2019. Henderson has made efforts to
respond to the requirements of the Adequacy Review, however, Henderson is in continuing discussions
with the Division related to the reclamation costs and has an in-person meeting with DRMS for November
7, 2019. It is likely that, whatever the outcome of this meeting, Henderson will not be able to meet the
requirements of this Adequacy Review request within the deadline of November 8, 2019. At this time
Henderson is requesting a waiver of our right to a decision by November 8, 2019 and requests an extension
of 60 days to the decision date.
Please find attached the documentation in compliance with the other requirements in your AM-07 Adequacy
Review Letter, as detailed below (DRMS comments are italicized):
6.4.3 Exhibit C— Pre-mining and Mining Plan Maps of Affected Lands
4. Pursuant to Rule 6.2.1(2)(b) maps must be prepared and signed by a registered land surveyor,
professional engineer, or other qualified person. Please provide a signed copy of the Exhibit C
Map.
Exhibit C maps have been updated with a signature block which meets the requirements of Rule 6.2.1(2)(b).
Aaron Hilshorst, the Chief Environmental Engineer for Henderson, has signed all maps in the capacity of a
qualified person.
5. The proposed Mine Site addition and reconciliation areas are not clearly identified on the Mining
Plan Map. Please revise the Exhibit C map to indicate the 1.3 acre Mine Site addition and the
48.3[acre]Mine Site reconciliation area.
Exhibit C maps have been improved to include the requested acreage. Maps Exhibit C, Exhibit C.A, and
Exhibit C.B include an aqua colored area called "'Reconciled' AM-07 Acreage" clearly identifying these
areas.
