COLORADO <br /> icow Division of Water Resources <br /> Department of Natural Resources <br /> Response to Reclamation Permit Application Consideration <br /> DATE: October 28, 2019 <br /> TO: Eric Scott, Environmental Protection Specialist <br /> CC: Division 1 Office, District 1 Water Commissioner <br /> FROM: loana Comaniciu, P.E. <br /> RE: SaturnX Mine, Permit No. M-2019-052 <br /> Operator: Colorado Sand Company, LLC <br /> Contact: Seth Sanders, Guidon Holdings, LLC, (864) 650-5694 <br /> SW1/4 of the SW1/4 of Sec. 12, Twp. 2N, Rng. 64W, 6th P.M., Weld County <br /> CONDITIONS FOR APPROVAL <br /> ® The proposed operation will consume ground water by: ® evaporation, ® dust control, <br /> reclamation, ® water removed in the mined product: <br /> Although ground water is not expected to be exposed at the site, the applicant is hereby <br /> notified that in the event that ground water is exposed at the site, the applicant will need to <br /> obtain either a gravel pit or other type of well permit, as applicable, unless the area is <br /> backfilled 2 feet above the ground water table. If the exposed ground water surface area is <br /> not backfilled, prior to obtaining a permit, an approved water supply plan or decreed plan for <br /> augmentation is required. <br /> ® Prior to approving a well permit, the applicant must conduct a field inspection of the site and <br /> document the locations of all wells within 600 feet of the permit area. The applicant must <br /> then obtain a waiver of objection from all well owners with wells within 600 feet of the permit <br /> area or request a hearing before the State Engineer. <br /> COMMENTS: The subject application is for a surface mining operation on approximately 206 permitted <br /> acres located in Section 12, Township 2 North, Range 64 West of the 61h P.M. The site will comprise 158 <br /> acres area to be mined, 48 acres of project operations including roads, material stockpiles and building <br /> including the 9.9 acres previously permitted under Keenesburg Project Permit No. M-2019-027. The <br /> primary commodity to be mined at the site is sand production. The area to be mined is currently used <br /> for agricultural purposes. <br /> The applicant has estimated that approximately 226,439 gallons/day or 0.69 acre-feet/day (253 acre- <br /> feet/year) will be consumed at the site from evaporation from washed sand, evaporation from <br /> clarifying tailing, dust control and evaporation from open water if ground water is exposed at the site. <br /> The source of water for these uses will be Laramie-Fox Hills aquifer ground water purchased from the <br /> property owner Guttersen Ranches, LLC, either pumped on site from well permit no. 83340-F or <br /> pumped and trucked to the site from well permit no. 79782-F. Well permit nos. 79782-F and 83340-F <br /> were issued in accordance with CRS 37-90-137(4) and the decree granted by the Division 1 Water Court <br /> in Case No. 2015CW3040. The use of ground water from each well is limited to domestic, commercial, <br /> industrial, irrigation, livestock watering, fire protection, replacement and augmentation purposes. <br /> Each well allows for a pumping rate of 100 GPM and an annual amount to be withdrawn of 160 acre- <br /> feet/year.
