JAMES A.BECKWITH <br /> FONTANARI OBJECTIONS AND COMMENTS I SNOWCAP BOND APPLICATION SL-1 I I PG.8 <br /> Subsidence Event B 1 Tract No. 71 Central <br /> This subsidence depression is situated wholly within the boundaries of Tract No. 71, and <br /> situated just east of Snowcap's repair project area. It was documented via GPS; photographs; <br /> and survey plat in Mr. Eldridge's 2016 and Updated 2016 survey plats: both of which were <br /> submitted to DRMS in Docket No. TR-69 together with the photographs of the depression and <br /> sinkholes. <br /> This depression has numerous sinkholes along its northern boundary, which is situated <br /> generally along the south face of the historic rock wall. In 2018, Fontanari dug a 2 feet deep <br /> trench along the southern face of the rock wall in preparation for installation of a 10" <br /> irrigation pipeline. This is part of his project to mitigate damages caused by coal mine <br /> subsidence. The digging destroyed the stakes identifying the locations of the sinkholes. A <br /> copy of the photographs of the depression and sinkholes is contained in Fontanari Exhibit 8. <br /> This depression is 100 feet long; 45 feet wide and, 5-7 feet in depth. <br /> Subsidence Event C 1 Tract No. 71 East <br /> On August 15, 2018, the DRMS Inspection Team resumed its transect of Tract No 71, <br /> starting at the approximate center of the tract. At Fontanari's request, Mr. Wein logged and <br /> photographed various points. These included Subsidence A and Subsidence B depressions; <br /> sinkholes on the adjacent Carey property, and sinkholes on the north side of the historic rock <br /> wall in Tract No. 71. In addition, Mr. Wein logged SCP 1027 (found among stored tree <br /> trunks) and an unlabeled tetrahedron also found among stored tree trunks. Tonya Hammond, <br /> Snowcap's agent, claimed that the location of the unlabeled tetrahedron was also the location <br /> of a monitoring well. However, such a monitoring Well has never been identified by either <br /> Powderhorn Coal Company or Snowcap in any of the 1987-2018 Annual Hydrologic Reports <br /> filed with DRMS. <br /> While transecting Tract No. 71, a large surface subsidence trough was found at the tract's <br /> eastern edge. Sinkhole lines were found on the eastern rim of this trough by DRMS <br /> representatives Messrs. Hernandez and Bowles. On August 16, 2018, Mr. Eldridge returned to <br /> Tract No. 71 to GPS, log, and take elevations of the rim and crater of this trough. (Fontanari <br /> Exhibit 13) On August 24, 2018, photographs were taken of the trough and the sinkhole <br /> areas. (See Exhibit 9.) <br /> Subsidence Event D 1 Tract No.35 <br /> On August 14, 20181, the Fontanari team advised the DRMS inspectors of a potential <br /> subsidence depression in the North Decline. On August 24, 2018, Mr. Eldridge, PLS 119809 <br /> 6 A brush fire along I-70 next to the Colorado River had interrupted the August 14th transect. <br /> 7 "SCP"—Subsidence Control Point as identified on the 1980 GEX Mine Map.
