D. Corley Jr. that the <br /> Inactive Mine Reclamation Program of the Division had conducted unpermitted mining on his <br /> property in conjunction with the filling of subsidence holes, also on his property. <br /> Dr. Corley accompanied this inspector to the excavation site and to the area of the <br /> subsidence holes. There is no existing state reclamation permit covering the site of the <br /> excavation of borrow material, on the Corley Ranch, so fair as this inspector is aware. <br /> The location of the excavated area is HE SE Section 24, W ON$ R70W 6th P.M., Fremont Co., <br /> inside the Corley Ranch. The area disturbed is estimated to be no more than 1/4 acre in size <br /> and involves removal of material from a stockpile of overburden material resulting from coal <br /> mining activity conducted nearby. The disturbed area is within the area of revoked Permit <br /> C-81-037 and is scheduled shortly for reclamation by the Coal Program of the Division an a <br /> result of the revocation of Permit C-81--037 and forfeiture of the reclamation bond. <br /> According to Dr. Corley, neither the removal of the material from this area of his property <br /> nor its use by the Inactive Mine Reclamation Program for the filling of subsidence holes, <br /> also on his property, was authorized by him. Reportedly, Dr. Corley's first knowledge of the <br /> excavation and transport of the borrow material was when he intercepted trucks belonging to <br /> Golden Drilling, Inc. loaded with the material and leaving the excavation site. Golden <br /> Drilling, Inc. was the contractor retained by the IMR Program to haul material to be used <br /> in filling subsidence holes located elsewhere on the Corley Ranch. Dr. Corley estimated that <br /> 23,5 truck loads possibly representing in excess of 100 tons of material were excavated and <br /> transported by the contractor for the IMR project. Golden Drilling, Inc. did eventually pay <br /> Dr. Corley, who admitted receiving the money, at the rate of $2 5,DQ per load, The contractor <br /> subsequently submitted invoices for this payment to the IHR Program and was reimbursed. <br /> During the inspection, Dr. Corley indicated a gray clay stockpile located some few hundred <br /> yards from the subsidence holes that he said he would have allowed to be used for fill,' w/o <br /> charge, had he been contacted in regard to the availability of borrow material for the holes. <br /> The site where the borow material was taken and dumped is estimated to be approximately 1/2 <br /> wile from the excavation site, in the SE SE of Section 24, also on the Corley Ranch. The <br /> roads/tracks on the ranch used by the trucks transporting the material to the area of the <br /> subsidence holes from the county road were also used by eguiptment under contract to the IMR <br /> Program to drill a series of holes in the same general area to define an area of local <br /> underground fire. Reportedly, this drilling project was done with Dr. Corley's knowledge and <br /> approval. Nothing has been done to reclaim the roade/tracks involved in the drilling <br /> project. <br /> Dr. Corley also indicated that, in addition to the surface disturbance involved in the <br /> excavation and transport of the borrow material by Golden Drilling, Inc., the ranch gate had <br /> been damaged by the haul trucks. Dr. Corley pointed out that the gate was subsequently <br /> replaced but the replacement was not properly installed and was not painted. <br /> Ae is the policy of the Division and the Minerals Program, where there is a possibility of <br /> unpermitted mining, both the operator and the landowner, in this case the IMR Program and Dr. <br /> Corley, respectively, recelve Reason To Believe Letters which, in this case, have indicated <br /> the possible violation will be scheduled before the Board during its November 17-18, 1993 <br /> meeting. <br /> Its E Contact Address cc:IMR Program <br /> NAME Dr. W.D.
