cleared up. The remaining reclamation of disturbed areas will be completed when this issue
is settled, and we again have permission to enter the property.
The Pioneer Canon Contract was structured to provide payment for performing the backfill
work using onsite materials designated by the Project Manager. Neither IML nor the
Contractor could have anticipated that the landowner (Dr. Corley), would charge a fee for
materials moved from one location on his property to another location on the sane
property, and being used to perform beneficial reclamation work in accordance with his
previous written requests, it is a changed condition of the work, and therefor the Contractor
should not have to pay this fee out of his own expense. I instructed the Contractor to
invoice IML for the fee imposed by Dr. Corley, and executed a change order to cover it.
In my opinion, Dr. Corley should not have the right to charge a fee and benefit financially
from Federally funded reclamation work which will benefit his property. Dr. Corley should
be required to return the fee to the IML program, or be found in violation for mining
without a permit, from property which is under the reclamation responsibility of the State.
If you have any other questions regarding this issue, or any others associated with the
Pioneer Ca$on Project, please contact me, and i will be happy to discuss them with you.
c Bruce Humphries, Minerals Program upervi.sor
