Page 2 <br /> Mr. Eric Scott <br /> October 1, 2019 <br /> - '#4"near the Town of Milliken property in the center of the map is black and not red text. <br /> This has been updated. <br /> The sewer line in WCR 48(assumed owned by Town and covered by Town of Milliken <br /> agreement), and none of the overhead electric lines within the permit or within 200'of the <br /> permit have been highlighted. These utility/lines have all been changed to a"red <br /> color". <br /> - Please remove unneeded items(such as the numbers in diamonds)from the map and <br /> legend. Unneeded items have been removed. <br /> - Permittee will need to commit to continue monthly water level monitoring for the site and provide <br /> data obtained in the annual report. See attached letter committing to continue to monitor <br /> groundwater levels. <br /> - Exhibit L -Reclamation Cost Estimate will need to include detailed information for the line item(s) <br /> for spillway construction. Costs for design/engineering, materials hauling, and <br /> placementYconstruction will need to be broken out for each spillway proposed. The design and <br /> engineering have been complete as presented in the Adequacy Review Response 2,the <br /> estimated cost includes haul, place bedding and riprap and grading. A 10%contingency <br /> was added. Recent work on a riprap project further to the east(Kersey,Colorado) reported <br /> costs at$60/cubic-yard for haul and placement. A copy of the bid for similar work is <br /> attached. <br /> Due to the liability to the State for slurry walls being damaged after installation, either by the mining process, <br /> or flood events prior to final release, DRMS bonding policy for slurry walls has recently been modified to the <br /> following practice: <br /> DRMS will require bonding for the full amount for slurry wall installation for any proposed or <br /> completed slurry wall until all flood control structures are in place, and the wall has been either fully <br /> orprovisionally approved by SEO. The Cell 2 wall has been approved and no flood structures <br /> are required as Cell 2 is out of the floodplain. Cell 3 has been approved and a spillway was <br /> constructed ten months ago by Central Colorado Water Conservancy District,the ultimate <br /> owner of the water storage ponds. Cell 4 is provisionally approved and Cell 5 has been <br /> provisionally approved and is not being mined. <br /> DRMS will reduce the bond for slurry walls that ha ve been installed, complete with all required <br /> flood control structures, and approved either fully or provisionally by SEO, by 80%(20%of full cost <br /> of wall to be retained in DRMS bond amount while slurry wall remains in the permit area). The <br /> bonding calculations have been updated. <br /> Upon final release of the slurry wall from the permitted area, the remaining 20%of the slurry wall <br /> bond will be released. Acknowledged. <br /> DRMS will accept the$5/SF cost for slurry wall installation for the purposes of estimating slurry <br /> wall costs at this site, unless actual installation costs can be documented/provided. $5/sq-ft was <br /> used in the bonding calculations. <br /> Please revise the Exhibit L costs to address the above issues. Reclamation costs provided will be reviewed <br /> by DRMS when all adequacy issues have been addressed. This Exhibit should be updated as needed to <br /> reflect all changes made during the adequacy review process. Acknowledged. <br /> Permittee still needs to obtain legal right of entry from Town of Milliken for the parcel in the permit located on <br /> the west side of the permit for Exhibit N, and information for Town of Milliken must be included in Exhibit 0. <br /> The Legal Right to Enter is attached to this response. <br /> This concludes the Division's third adequacy review of this application. This letter shall not be construed to <br /> mean that there are no other technical deficiencies in your application. Other issues may arise as additional <br />
