COLORADO <br /> ' a Division of Reclamation, <br /> Mining and Safety <br /> Department of Natural Resources <br /> September 24, 2019 <br /> Mike Bynum <br /> Colorado Milling Company, LLC <br /> 50 West 100 South Street <br /> Moab, UT 80342 <br /> Re: Gold Hill Mill, Permit No. M-1994-117, Colorado Milling Company,LLC <br /> Notice of Approval Decision for a 110(2)Amendment Application (Revision No. AM-1) <br /> Dear Party and/or Interested Person: <br /> As you were noticed on June 12, 2019, the Amendment application (AM-1) submitted for the above <br /> referenced permit was denied by the Division on that date, after it was determined AM-1 did not satisfy <br /> the requirements of the Act. This notice also informed you that the operator's failure to obtain approval of <br /> AM-1 was considered a possible violation for failure to comply with the conditions of an order, permit or <br /> regulation pursuant to C.R.S. 34-32-124(1), and accordingly, the matter was set for consideration by the <br /> Mined Land Reclamation Board (Board)at its June 26-27, 2019 meeting. <br /> Please be informed, during the June 26, 2019 hearing, the Board found the operator to be in violation of <br /> C.R.S. 34-32-124(1) and 34-32-118(1)(b) for failure to comply with the conditions of a Board Order, <br /> specifically the corrective actions in the Board's Order issued for violation No. MV-2017-036. However, <br /> the Board also ordered the Division to stay its denial of AM-1 for 90 days from the date of the hearing(to <br /> September 24, 2019) to allow the operator additional time to address the remaining adequacy issues. A <br /> copy of the Board Order for this hearing which was mailed to the operator on August 13, 2019 is enclosed <br /> for your review. <br /> During the extended 90-day review period for AM-1,the Division issued a 5t1i Adequacy Review letter to <br /> the operator on July 23, 2019, and the operator submitted a response to this letter on September 16, 2019. <br /> After reviewing the materials submitted, the Division determined the operator had sufficiently addressed <br /> all remaining adequacy items for AM-1. Therefore, on September 18,2019,the Division approved AM-1. <br /> In accordance with Rule 1.4.11, if you wish to appeal the Division's decision on this Amendment <br /> application, you must petition for a hearing before the Board within sixty (60) days of the date of the <br /> Division's decision(by November 17,2019). Such a petition for a hearing must state how you are directly <br /> and adversely affected or aggrieved by the Division's decision, and how your interests are entitled to <br /> protection under the Act. The petition must list and explain any issues you believe should be considered <br /> by the Board at the Hearing on the matter.
