I <br /> The Board orders as follows: <br /> The Division shall stay its denial of AM-1 for ninety days from the Board's <br /> June 26, 2019 hearing to review and address the remaining adequacy issues. <br /> Colorado Milling Company,LLC shall CEASE AND DESIST all mining- <br /> related activities on lands located within or outside the approved a0ected land <br /> boundary,including the installment,replacement, maintenance,oit use of any <br /> infrastructure or underground mine workings intended to convey oor store water for <br /> the operation. <br /> The Board imposes the following CORRECTIVE ACTIONS,against Operator: <br /> A. The Division and Operator shall continue to resolve atiy remaining <br /> adequacy issues for AM-1; <br /> B. The Division will provide the Board with a status updpte regarding <br /> Operator's efforts to resolve the remaining adequacy issues der thirty days <br /> from the Board's June 26,2019 meeting; <br /> C. Operator has ninety days from the Board's June 26, 2019 meeting to <br /> resolve the remaining adequacy issues to the Division's satisfaction;and <br /> D. Operator shall post an additional$21,000.00 in surety,bond within ten <br /> business days of the Board's June 26,2019 meeting. <br /> The Board imposes a CIVIL PENALTY of$50 per day for 36 days of violation <br /> for a total civil penalty of$7,200 pursuant to section 34-32-124(7), C.R.S. The civil <br /> penalty shall be due and payable within thirty(30)days of the effective date of this <br /> Order.
