Black Mountain Sand Weld LLC <br /> 500 Main St. Suite 1200, Fort Worth,TX 76102 <br /> (817) 698-9901 <br /> As stated above,the facility initially identified as a Kinder Morgan utility box is not owned by Kinder Morgan <br /> and the current owner of the facility is currently unknown. Until such time as the utility box owner is <br /> identified and a structure agreement is in place or a notarized no negative effect letter is received, or it has <br /> been verified the utility box can be removed, Black Mountain will maintain a 200-foot buffer surrounding <br /> the utility box. <br /> A subsequent survey of the site to identify additional potential utilities and easement holders did not result <br /> in any new identifications.All known and identified structures and easements within the permit boundary <br /> and within 200 feet of the affected lands boundary are shown on Exhibit C2: Pre-Mining Map in Attachment <br /> C. One old livestock watering well was identified at the site that predates permitting requirements.This well <br /> is located approximately in year 30 of the life of mine.The well is not in use and will be plugged and <br /> abandoned per state regulations and mined through as mining operations progress. The location of this well <br /> is shown on Exhibit C2: Pre-Mining Map in Attachment C. <br /> Item 28— Exhibit C6.1-6.2 <br /> Confidential Exhibit C6.1-6.2 has been modified per the request of the division.
