Included <br /> below are those parties and the reasoning for their notification: <br /> • Bank of Kansas City et al.Trustees—this party was notified during the April public notice period because <br /> they were a surrounding landowner,owning property adjacent to Section 4.The permit boundary has <br /> since been modified and they are no longer a surrounding landowner. <br /> • H. Edward Vollmers—Mr.Vollmers was notified during the April public notice period because he holds <br /> mineral ownership for oil and gas rights within Section 4,which was part of the old permit boundary. <br /> The permit boundary has since been modified and he is no longer required to be notified. <br /> • Stephen L. Beaghler—Mr. Beaghler was notified during the April public notice period because he was a <br /> surrounding landowner at the time, owning property adjacent to Section 4.The permit boundary has <br /> since been modified and he is no longer a surrounding landowner. <br /> • Westport Oil and Gas Company, LP—Westport was notified because they hold mineral ownership for oil <br /> and gas rights within portions of the permit boundary. <br /> Through an additional due diligence mineral ownership search conducted by Black Mountain as part of their <br /> deed work,the following additional parties have been identified and notified; proof of mailing and delivery <br /> is provided in Attachment A: <br /> • Taets van AM One LLC—holds mineral ownership of oil and gas rights within portions of the permit <br /> boundary <br /> • Charles Phillip Fairchild,Trustee of the Charles Phillip Fairchild Trust—holds mineral ownership of oil and <br /> gas rights within portions of the permit boundary <br /> • Mazelle E. Kingsbury—holds mineral ownership of oil and gas rights within portions of the permit <br /> boundary <br /> • Loren Latker—holds mineral ownership of oil and gas rights within portions of the permit boundary <br /> • Delisle A. Lemieux,Trustee- holds mineral ownership of oil and gas rights within portions of the permit <br /> boundary <br /> An additional oil and gas rights mineral owner,Jacolyn K. Pettygrove of Portland, OR, was also found during <br /> the due diligence search. However, all available records indicate she is deceased, and her beneficiary(s) are <br /> unknown. <br /> Black Mountain also sent additional notifications to the following parties; proof of mailing and delivery is <br /> provided in Attachment A: <br /> • Lost Creek Land &Cattle Co.—Lost Creek Land & Cattle Co. are the former owners of the property <br /> currently proposed for use in the mining application.They were previously notified. However, a new <br /> address was provided so additional notification was sent to the new address. <br /> • Conoco Phillips—Conoco Phillips is listed as the current operator of onsite oil &gas well Prospect- <br /> Royalty#1 (API 05-123-05129), whose current status is dry&abandoned, as provided in Attachment 4 <br /> of the Adequacy Response Letter dated 9-12-19. Notification letters were previously sent to the address <br />
